Take-Two GTA bid dismissed
p2pnet.net News:- With its just-launched Bully video game now on sale - or not, depending on where you are - Take-Two Interactive has probably been crossing its metaphorical fingers, praying the GTA San Andreas Hot Coffee sex-scene mess would just fade away.
But no such luck and in fact, its bid to have, "some claims in a lawsuit accusing it of selling ‘Grand Theft Auto’ video games containing sexually explicit images under the wrong content label" dismissed has failed, says Reuters.
Even worse, given the bad PR it’s bound to generate, Florence Cohen, "An 86-year-old Bronx, N.Y., grandmother won the first round of her battle to get back the US$50 she shelled out" for the game, says the New York Daily News.
She took on Take-Two Interactive Software and Rockstar Games last year, saying she’d bought GTA: San Andreas (at the time, it was rated ‘M’ for mature instead of Adults Only, as it was later tagged) without knowing about the secret animated sex module.
Meanwhile, the lawsuit seeking class-action status, filed in July last year, "said Take-Two’s alleged misconduct violated consumer protection laws in all 50 states and the District of Columbia. Since then a number of cases making the same claim were consolidated in Manhattan federal court," states Reuters.
"Take-Two and its subsidiary, Rockstar Games Inc., had argued in its motion to dismiss parts of the lawsuit that the plaintiffs could only file claims in the states where they resided, not all 50 states."
But US district judge Shirley Wohl Kram said she’d think again, "if class-action status were granted in the case," it adds.

“Cohen sued Take-Two Interactive Software and Rockstar Games last year after buying a copy of the multimillion-selling game in 2004 for her 14-year-old grandson, only to discover that secret sex scenes appear when special codes are used.”
So the 86 year-old thinks a violent “Mature” (17+) rated game is suitable for a 14 year-old; but the remnants of a sex mini-game buried in the game code, which can only be accessed through a hack, is of course unpalatable. WTF?
