p2pnet.net News:- BlackBerry maker RIM wants every new Samsung BlackJack phone trashed. Literally.
It’s suing Samsung Electronics, accusing it of trademark infringement, and as well as demanding unspecified damages and legal costs, also wants Samsung to, "deliver to RIM for destruction" every item, "that bears the BlackJack mark that the company holds or has sold," says Reuters.
RIM, based in Canada, alleges "Samsung’s use of ‘BlackJack’ in connection with a smart phone amounts to, "unfair competition and trademark dilution," says The Associated Press.
"The BlackJack was introduced last month in the United States by Cingular Wireless, which also happens to be the largest purveyor of BlackBerry devices and e-mail service," says the story.
With, "intentional disregard for RIM’s trademark rights, Samsung has used the BlackJack mark in a manner which is confusingly similar to RIM’s BlackBerry marks," RIM states, according to Reuters.
RIM goes on, "as a result of such acts, Samsung is misleading the public into falsely believing that Samsung’s goods and services are connected with RIM’s business."
