The RIAA versus the EFF

p2pnet.net news:- Warner Music, EMI, Vivendi Universal and Sony BMG’s RIAA (Recording Industry Association of America) says New Yorker Rolando Amurao is another of those hundreds of millions of “thieving criminals” who are “devastating” the corporate music industry, ie, Warner Music, EMI, Vivendi Universal and Sony BMG.

However, Amurao says Lava Records, Warner Bros Records, Capitol Records, UMG Records, Sony BMG Music Entertainment, Arista Records and BMG Music’s RIAA have misused the copyright act and with that as a backdrop, he’s asking for a declaratory judgement of non-infringement, with the RIAA predictably trying to have the claims dismissed.

Amurao is not, however, alone. He has the EFF (Electronic Frontier Foundation) on his side and it says the lawsuit is no more than another, “skirmish in the broader war” the RIAA is waging, with “thousands of ordinary people around the country, including grandmothers, grandfathers, single mothers and teenagers….” as the targets.

The foundation makes the statement in an amicus brief, a “”friend of the court” document from someone who’s not a party to a case, but who, “volunteers to offer information on a point of law or some other aspect of the case to assist the court in deciding a matter before it,” says the Wikipedia.

Naturally, the last thing the RIAA or its masters want is a carefully considered argument which might help a judge decide it’s been incorrectly and/or improperly using the copyright act. So it’s opposing the EFF’s motion, says Recording Industry vs The People.

Use emails, snail-mail, phone calls, faxes, IM, stop them in the street, blog. And if you’re into organizing, organize petitions, organize demonstrations and then turn up on your local political rep’s doorstep, making sure you’ve contacted your local tv/radio station/newspaper in advance. Don’t just complain. Do something!
