Google chops ‘greencompostheap’

p2pnet.net news:- We just had an email from someone who’d read our post on the latest defamation lawsuit aimed at Google.

It wondered if we might be interested to know Google has apparently reacted strongly to the item Vancouver businessman Wayne Crookes is complaining about in his lawsuit against Do No Evil.

“On or about August 7, 2006, Anonymous #1 posted an article on the blog site The green compost heap entitled ‘Blow it out your tailpipe’ which had the url of http://greencompostrhead.blogspot.com/2006/blow-it-out-your-tailpipe.html,” says Crookes’ writ of summons addressed to Google, found as S-072591 at the Vancouver Registry in the Supreme Court of British Columbia.

But, “Crookes only had a complaint about one post, and some comments,” observed our correspondent, who’d taken the trouble to read Bloggers Terms of service which referenced this:

Defamation/Libel. Users should not publish any content that is unlawful, defamatory, and fraudulent. Note that an allegation defamation. The truth or falsehood of a bit of expression is a key element in establishing defamation, and we are not in a position to make that sort of fact-based judgment. That said, if we have reason to believe that a particular statement is defamatory (a court order, for example), we will remove that statement.

“Instead,” says our source, “they seemed to have removed the entire blog.”

“Chill indeed.”
