Eminem sues Apple: the sequel

p2pnet news | music:- Marshall Mathers III is suing Apple.

Again.

Marshall Mathers III is better known as Eminem and his Eight Mile Style and copyright manager, Martin Affiliated, say Apple allowed unauthorized downloads of MnM songs to iPods.

And that’s a “multimillion-dollar” transgression, according to a lawsuit launched on Monday, says the Associated Press.

Way back in the distant reaches of time, Eminem was reportedly “Enraged” at Apple’s “unauthorized use of his music” in a tv commercial.

Or as p2pnet reader daveslounge expressed it, “My guess is it’s another publicity stunt. If the man had breasts I’m sure he’d get whatsherface Jackson to rip off his costume on live TV!”

California entertainment lawyer Owen Sloane is acting for Eminem and he says a related issue, “is how the 60.9 cents the recording label has left after it pays the music publisher should be divided between the recording label and the artist,” according to the Detroit News, which goes on:

If downloads are treated as licensing agreements, the 60.9 cents would be split equally, Sloane said. But if a download is treated as a sale, which is typical, the artist only gets a royalty, or a much smaller share of the 60.9 cents.

Earlier, “Typically, Apple collects 99 cents each time an iPod owner downloads a song, with Apple paying 70 cents of that amount to the recording label,” the story had Sloane stating.

The recording label, in turn, typically pays 9.1 cents to the music publisher, he said.
