Judge Allows RIAA to Serve Subpoena on Defendant’s Former Employer in Atlantic v. Shutovsk

In Atlantic v. Shutovsky, pending in Manhattan, the Judge has issued an order ruling on a number of discovery issues. No written opinion was issued. Among the Court’s rulings were the following:

-The plaintiffs were permitted to serve a subpoena on Mr. Shutovsky’s former employer;

-The plaintiffs were permitted to take depositions of Mr. Shutovsky’s wife and his brother;

-The court stayed defendant’s discovery in support of his counterclaims for copyright misuse and declaratory judgment.

-Plaintiffs were required to produce all non-privileged documents or materials relating to any investigation and any sound files on their computer, and to produce a privilege log as to any claimed to be privileged.

-Plaintiffs did not have to turn over documents relating to their employees of ‘online media distribution systems’.

-Defendant was required to provide the name and address of each person who used his computer during the three (3) years prior to commencement of the lawsuit.

-Defendant was required to produce all hard drives in his possession and control.

-Plaintiffs were required to furnish copies of copyright registrations for every song they assert was unlawfully downloaded.

Undercover hack rumbled by hackers

An NBC reporter dicovered what it was like to be pursued by the ‘geek paparazzi’ after she tried unsuccessfully to go undercover at a hackers conference. Michelle Madigan, a reporter with Dateline, was apparently hoping to get one of the delegates at DefCon to confess to having committed a crime while being filmed on a hidden camera. But her cover was blown when she unwittingly confided her plans to a DefCon insider, resulting in scores of hackers and other reporters pursuing her through the conference car park armed with video cameras. A clip of the incident is on YouTube.

Nokia to use Microsoft’s latest DRM software

Nokia Corp. has agreed to license Microsoft Corp.’s new PlayReady DRM (digital rights management) technology, giving the service providers it works with a greater choice of copy protection software. The deal extends Nokia’s existing copy protection offerings, which include Windows Media DRM 10 and OMA DRM (Open Alliance Mobile DRM) …..

They’re invading MySpace

Social networking web sites such as MySpace.com are increasingly juicy targets for computer hackers, who are demonstrating a pair of vulnerabilities they claim expose sensitive personal information and could be exploited by online criminals. The flaws were demonstrated last week at the Black Hat and Defcon hacker conferences, which draw thousands of people to Las Vegas each year for five days of training.

Bloggers seeking to form a labor union

In a move that might make some people scratch their heads, a loosely formed coalition of left-leaning bloggers is trying to band together to form a labor union it hopes will help members receive health insurance, conduct collective bargaining or even set professional standards. The effort is an extension of the blogosphere’s growing power and presence, especially within the political realm, and for many, evokes memories of the early labor organization of freelance writers in the 1980s.
