US Army sgt retreats in RIAA case
p2pnet news | RIAA News:- A US soldier who’d vowed he’d take on Warner Music, EMI, Vivendi Universal and Sony BMG’s RIAA has decided he doesn’t want to do battle after all.
US army sergeant Nicholas Paternoster, 33, said he’d fight the labels, claiming the RIAA RIAA (Recording Industry Association of America), “violated his privacy and abused copyright law, as well as engaging in a conspiracy to defraud American courts,” p2pnet posted in July.
But, “Plaintiffs WARNER BROS., et al. (’Plaintiffs’) and Defendant NICHOLAS PATERNOSTER (collectively the ‘Parties’), by and through their undersigned counsel, respectfully notify the Court that the Parties have settled their dispute in principle,” says No. 3:07-cv-00264 tersely, lodged at the end of last month and quoted by Knoxville News Sentinel.
“The Parties request 45 days to finalize their settlement agreement and submit the appropriate paperwork to the Court dismissing this matter,” it adds.
Stationed at Fort Campbell, Tennessee, Paternoster was accused of being an illegal online distributor of copyrighted music, using Sharman Networks’ Kazaa as the tool.
Of seven Tennessee cases filed in March this year, “court records show that only Paternoster has challenged the recording industry’s charges,” said Knoxville News Sentinel, originally reporting the case.

I used to be in the army but I got injured before I was sent to Iraq. Most of these guys are meat heads, some of them are great people but bone heads others are just completely ignorant of anything that doesn’t involve guns.

Militarism is one of the remaining (but veiled) forms of slavery. And who controls the slaves? A pro RIAA, pro content owners cartel president. What else was to be expected.
One thing we will likekly never learn: How much was paid to whom, if anything beause of the immoral, anti free speech “no talk” clause in the settlement agreement.
