daTruthSquad triumphs
p2pnet news | Freedom:- “Litigants don’t get a blank check to pry into the private lives of critics when they say things the litigants don’t like. The fact that it is the government trying to abuse the discovery process makes this attempted invasion of privacy all the more repugnant.”
That was the EFF’s (Electronic Frontier Foundation) Matt Zimmerman when the township of Manalapan subpoenaed Google for daTruthSquad’s ID, as well as for emails, blog drafts, and other information Google had about the blogger.
It claimed the squad had written posts which criticized a malpractice lawsuit filed by Manalapan against its former city attorney.
But yesterday superior court judge Terence Flynn quashed the subpoena, ruling the blogger had a First Amendment to anonymous speech.
Says the site:
“In life, if you don’t like what someone says, you have da right not to listen. If you don’t like what da blog says, click on ‘exit.’ If you don’t like what is on TV, change the channel, or on da radio, then listen to something else. If you don’t like what da newspaper says, cancel da subscription. If it’s a free newspaper, then leave it on your wet lawn. These are all very simple rules, and yet they’re not even rules. It’s common sense.”
