A perpetual chilling effect is all that's needed to contain fair use art as a tiny Internet-only phenomenon. Just make sure fair use artists stay too scared to ever offer their work for sale and compete for consumer dollars. No new lawsuit necessary. Plenty of past and ongoing lawsuits, from the likes of J.
