We have learned that the "status conference" which the RIAA requested in the default judgment case, Atlantic v. Brennan, which the Court granted and scheduled as a telephone conference to take place on Monday, April 14th, at 10:30 A.M., will take place in open court over a speakerphone.
So the proceedings will be open to the public.
Here are the details:
Date: Monday, April 14, 2008
Time: 10:30 A.M.
Place: Courtroom of Hon. Janet Bond Arterton
United States District Judge
United States District Court
District of Connecticut
Richard C. Lee United States Court House
141 Church Street
New Haven, CT 06510
Directions to courthouse (pdf)
The February decision in Atlantic v. Brennan was the first of the three recent decisions rejecting the RIAA’s "making available" theory.
[Ed. note. Please try to attend and see what "RIAA Richard" has to say to Judge Arterton. And what he leaves out. -R.B.]
Aterton, you’ll recall, gave Warner Music, EMI, Vivendi Universal and Sony BMG and their adherents serious pause when she decided they have to prove "actual distribution of copies" instead of merely relying on song files being "available" on the defendant’s computer.
Definitely stay tuned.
