Thomas lawyer Toder praises RIAA’s Gabriel

p2pnet news | RIAA News:- Brian Toder, the attorney who unsuccessfully acted for Jammie Thomas, the only one of the RIAA’s 40,000 victims to appear a civil court, was instrumental in helping Richard Gabriel, the RIAA lawyer who defeated him, gain a much-coveted post.

Gabriel was under consideration for a judgeship in Colorado and officials who were vetting the RIAA lawyer called Toder, seeking his opinion.

“I gave him a very favorable rating,” Wired has Toder saying.

“I think he’s a standup guy and a good lawyer. And I think he would be a good judge.”

Recording Industry vs The People’s Ray Beckerman, who’s defending several RIAA victims, was more than taken aback by Toder’s enthusiastic praise.

“I am beyond speechless,” he says on his site.

Gabriel is to take up his new job on July 1.

    This is odd praise. I can see that, in the context of “a lawyer just doing his job, and working within the confines of the law, as written”, and the evidence provided to him, it’s entirely possible for this appointed judge to be exactly what he’s praised to be, “a stand up guy”.

    Makes me seriously reconsider my earlier statements on the previous article concerning the Colorado Governor, and his decision. I find that the praise “He’s a stand up guy” isn’t likely to be used lightly, and often denotes exceptional character.

    I am outraged.

    I have far more experience litigating with Mr. Gabriel than does Mr. Toder. The Colorado officials did not do their job very carefully by allowing Mr. Gabriel to hand pick his references. That is not “due diligence”.

    i remember seeing that gabriel was the lawyer in the santangelo case and this is all i could find here http://p2pnet.net/story/11777 but i am sure there must be others.

    is that what laywers do? that is what they do in criminal cases but this is a civil case for copyright infringment not sime terrible crime

    Seems Mr Toder’s sympathies did not lie with his client but with the other side, and his heart wasn’t really in it when representing Ms Thomas. So much for lawyer loyalty. Else he figures “if you can’t beat em …”

    “Speechless” might be a good description of much of Brian Toder’s defense of Jammie Thomas. Throughout the trial, Gabriel made many false assertions that went unchallenged by Toder. Among these were things that any half-decent computer/network tech could have easily disputed.

    I find it telling that Colorado officials apparently did not think to contact the one person who is probably more familiar with Richard Gabriel’s ethics and character than anyone else of recent — and evidently the most outspoken on the issue.

    No wonder Jammie lost her case. (sick) Sounds like this Toder character was put up by the RIAA to make sure that Jamme would lose the case. That would explain his lame defence of Jammie in court.

    Hopefully the truth will out eventually and it will go against the RIAA. Bastards.

    a defending counsel who helps the plaintiffs council pick a jury that will crucify
    his client in addition to a judge who’s family collects money fron the RIAA
    ( Judge Davis — Miles Davis estate ). This isn’t corrupt at all. is it ?

    It would seem that international bankers no longer run the United States. The Mafiaa is able to buy defense lawyers, judges, appointment boards… and they now have one of their own placed behind the bench. Is the American system this oblivious!? Jammie “example” Thomas must be livid.

    How can anyone say the system works? Works for who? The political system is designed to protect the rich from the poor and the poor from the rich, but this legal system - that seems a one way street.

    Hey Country Lawyer - congrats on 3 million! You guys do amazing work.

    I’m assuming there a position of ethics or policy that would preclude Gabriel from hearing cases involving a party he used to represent. Am I assuming correctly, or could he maintain an influence over RIAA cases? Is it possible that a Jammie Thomas type of appeal could end up at his feet?

    Richard Gabriel, if you’re reading this - Jammie Thomas doesn’t deserve a $222,000 fine. It’s wrong, and you know it, and you’re profiting from it. Would you chase your children, neices, nephews or cousins the same way? Would they deserve such a fine for such an infraction?

    Congratulations on your new post. You truly deserve it.

    No, he’s a state court judge. They don’t get copyright cases. Even if he were a federal judge and had RIAA cases brought before him, he would have to be recused.
