		<description>No, he's a state court judge. They don't get copyright cases. Even if he were a federal judge and had RIAA cases brought before him, he would have to be recused.</description>

		<description>Hey Country Lawyer - congrats on 3 million!  You guys do amazing work.

I'm assuming there a position of ethics or policy that would preclude Gabriel from hearing cases involving a party he used to represent.  Am I assuming correctly, or could he maintain an influence over RIAA cases?  Is it possible that a Jammie Thomas type of appeal could end up at his feet?

Richard Gabriel, if you're reading this - Jammie Thomas doesn't deserve a $222,000 fine.  It's wrong, and you know it, and you're profiting from it.  Would you chase your children, neices, nephews or cousins the same way?  Would they deserve such a fine for such an infraction?

The Mafiaa is able to buy defense lawyers, judges, appointment boards... and they now have one of their own placed behind the bench.  Is the American system this oblivious!?  Jammie "example" Thomas must be livid.

How can anyone say the system works?  Works for who?  The political system is designed to protect the rich from the poor and the poor from the rich, but this legal system - that seems a one way street.</description>

 "Speechless" might be a good description of much of Brian Toder's defense of Jammie Thomas. Throughout the trial, Gabriel made many false assertions that went unchallenged by Toder. Among these were things that any half-decent computer/network tech could have easily disputed. 

I find it telling that Colorado officials apparently did not think to contact the one person who is probably more familiar with Richard Gabriel's ethics and character than anyone else of recent -- and evidently the most outspoken on the issue.</description>

I have far more experience litigating with Mr. Gabriel than does Mr. Toder. The Colorado officials did not do their job very carefully by allowing Mr. Gabriel to hand pick his references. That is not "due diligence".</description>

		<description>This is odd praise. I can see that, in the context of "a lawyer just doing his job, and working within the confines of the law, as written", and the evidence provided to him, it's entirely possible for this appointed judge to be exactly what he's praised to be, "a stand up guy".

Makes me seriously reconsider my earlier statements on the previous article concerning the Colorado Governor, and his decision. I find that the praise "He's a stand up guy" isn't likely to be used lightly, and often denotes exceptional character.</description>
