Tanya Andersen awarded $108,000

p2pnet news | RIAA News:- RIAA nemesis Tanya Andersen has achieved another milestone victory.

She fought Vivendi Universal, EMI, Warner Music and Sony BMG’s RIAA to a standstill, forcing it to drop its spurious file sharing case against her, and now an Oregon court has awarded her close to $108,000 in fees and costs.

The amount, the highest ever, also signals what is in effect a default victory for other lawyers representing RIAA victims.

It means they now know they’ll be able to proceed with counterclaims bolstered by the knowledge they’ll be paid their work.

“This will assist in levelling the playing field in other cases,” Andersen’s lawyer, Lory Lybeck, told p2pnet.

It’s also only the second time these kinds of fees and costs, which count for up to July 1 last year, have been awarded, he says.

But Andersen’s fight to prove even a single mother on a medical disability pension can take on a multi-billion-dollar Big 4 labels and win, isn’t over yet.

The RIAA, with soon-to-be Colorado judge Richard Gabriel still fronting for it, has been failing to produce discovery documents demanded by Andersen’s lawyers, Lybeck and Ben Justus.

“Tanya has suffered long enough and must be allowed to fully litigate her claims and the claims of other potential class members without further delay of the RIAA,” Lybeck told p2pnet recently.

The subject of a major Business Week feature, she was selected by the Big 4 extortionate outfit is an easy mark in its bizarre sue ‘em all marketing campaign.

But she decided she wouldn’t be terrorised by the Big 4 bullies who, as part of their efforts to bring her to heel, also targeted her then seven year old daughter, Kylee.

Meanwhile, the RIAA’s Gabriel won’t take up his new job until July 1, so expect him to file a lengthy and fulsome appeal.

    She is counter-suing for damages. The award of legal fees is just for her cost of defending against the RIAA’s case, which was dismissed with prejudice.

    This is great News and encouraging to others. This case should be followed closely too by all RIAA victims. It isn’t over yet but they will never produce required documents or evidence until forced to. I would encourage Tanya to continue in her mission as intended and not give up. Millions are with you in this. They need to be hit where it hurts, and that means BIG sums of money. Billions, not 1000s. Of course Tanya wouldn’t get that, but it can be required in fines, and jail time would certainly be in order for many of them. Tanya is entitled to more than just her legal fees though, and should get compensation for harassment and medical bills incurred, as well as for the selfless service she is doing for others. This case ought to demonstrate to these thugs that money doesn’t buy everything, and never to underestimate a victim, no matter who they are or whatever their financial status or age.

Heere’s a novel idea, class action lawsuit against the RIAA for having forced us to continually upgrade our hardware and internet service at OUR EXPENSE, perpetually bleeding us dry, because thanks to them our hard drives are overflowing and our bandwidth is congested. It’s their fault ISP’s are doing deep packet inspection, invading our privacy, and throttling our freedom. Misses Anderson, yyyyyyou’re my hhheeeero…in. Since she’s all rich and stuff now I wonder if she’s single? hmmmm

    She’s not rich. Far from it. And I can tell you this, even if she was loaded with cash, it wouldn’t even begin make up for all the suffering she’s been through because of Judge Gabriel and the RIAA jokers.

    I’m looking forward to hearing the real figures for damages and about the inevitable class action lawsuit that will bury the RIAA and their thuggery forever.

    I wonder if the shoe is on the other foot.
    Their appeal will cost Tanya even more in legal fees.
    Will the RIAA be responsible for the legal fees incurred by the
    appeal, in addition to what she was already awarded if they lose the
    appeal ?

    If so maybe the RIAA would be smart and settle now, or pay more later :)

    Im sure the RIAA will do every thing in their power to not lose this one. This could be real damaging to them if people were to find out that they can counter sue for legal fees etc.
