QuebecTorrent goes offline

L’opération des torrents de ce site a été suspendue par ordonnance de la Cour supérieur du Québec rendue le 9 juillet 2008 laquelle:

ORDONNE aux défendeurs Sébastien Brûlotte et Québectorrent.com inc., leurs officiers, administrateurs, employés, représentants, mandataires et à toute personne agissant directement ou indirectement en leur nom ou selon leurs instructions, ainsi qu’à toute personne au courant de l’ordonnance à être rendue en l’espèce, sous toute peine que de droit, immédiatement et sans délai de mettre fin à l’opération des torrents du site Québectorrent et de s’abstenir de permettre ou de faciliter la reproduction d’œuvres protégées par droit d’auteur en utilisant la technologie « bittorrent », « peer to peer » ou toute autre technologie.

The torrents on this website has been closed as per judgment by the Superior Court of Quebec rendered on July 9, 2008 stating:

ORDER the defedants Sébastien Brûlotte and Quebectorrent.com inc., their officers, administrators, employees, representatives, mandator as well as any person acting directly or indirectly on their behalf or according to their instructions, as well as to any person informed of the present injunction to immediately close the torrents on these website Quebectorrent and to refrain from being involved in any website using the bittorrent technology, peer to peer, or any other technology allowing the download of any work protected by copyright.

The statements represent a rare Canadian victory for Vivendi Universal, EMI, Warner Music and Sony BMG in their fruitless efforts to gain exclusive control of how, and by whom, music is distributed online.

Cease and Desist demands

“Although Quebec’s ADISQ (Association québécoise de l’industrie du disque, du spectacle et de la vidéo) isn’t at all sure suing file sharers is the way to go, it seems sites are fair game,” p2pnet posted in November last year, continuing:

“Go after torrent trackers, says the organization and with that in mind, QuebecTorrent was also the recipient of Cease and Desist demands.”

Also last year, “The administrator of the 1 year old, 46,000 member ‘QuebecTorrent’ has received Cease and Desist letters from 4 record labels and is being threatened with further action if they don’t comply,” said p2pnet, adding >>>

The demands are:

a) Close the site www.quebectorrent.com and any other site of similar nature which you operate.

b) You must agree to never again directly or indirectly operate any other service which enables the sharing of music.

c) You must post a message clearly indicating the closure of the site and inform your users that sharing music via p2p networks is forbidden by Canadian copyright law unless permission is obtained and royalties paid.

The last part of C doesn’t seem to have been met and in the meanwhile, there’s at least one positive aspect.

“In all, 31 organizations went after QuebecTorrent, demanding $200,000 in punitive damages,” says TorrentFreak.

But, the monetary demand was dropped, says the story.

    To begin with, they have not infringed copyright by tracking torrents. The law really is an ass after all, as are all naive judicial types who are led and deceived by the cartels. In response to demand B, just arrange for someone else to set up a new site, and the Quebectorrent owners can be in charge, behind the scenes of course.

    The site is infected with a rootkit!

    It is the almost the same rootkit used by Sony! How strange!
    It will try to infect you computer with a rootkit hiding anyfile or folder with name starting with css.
