‘Still a long way to go’: RIAA victim Tanya Andersen

They depend on us, not the other way around, and yet they treat us like dirt.

Big 4 attempts to gain control of who does what, and how they do it, online have been on a loser since 2003 when they first started trying to sue their own customers into buying Big 4 ‘product’ and only Big 4 ‘product’.

They’ve spent millions of dollars on their ridiculous and bizarre sue ‘em all marketing campaign, but they’ve only managed to achieve two things:

  • They’ve clued people in on downloading and file sharing; and,
  • They’ve started a brand-new class of online consumers who don’t want anything to do with the corporate music industry.

Tanya Andersen is a former Big 4 customer accused by the labels of being a criminal and a thief.

Vivendi Universal (France), Sony BMG (Japan and Germany), EMI (Britain), and Warner Music (US) hounded Tanya and her young daughter, Kylee, making their lives thoroughly miserable.

However, with the legal team of Lory Lybeck and Ben Justus beside her, she fought back.

And she won.

The labels and their RIAA tried to nickel and dime her lawyers out of what was owed to them, but they failed in that too and have just been forced to pay almost $108,000 in legal fees.

Next up, Tanya herself will be looking for financial retribution.

Will they cave in relatively quickly, as they did with the legal fees?

 “My lawyers worked extremely hard defending this case and it was very important to me that they get paid.

Atlantic v Andersen is over, but there’s still a long way to go with the class action and my personal claims.

The RIAA, Atlantic Recording, Priority Records, Capitol Records,  UMG Recordings, BMG Music, Safenet, and the Settlement Support Center have been in my life now for about four long years (including the time before the lawsuit was actually filed.)

I never infringed anyone’s copyrights and for whatever reasons these companies decided it was okay to turn an innocent person’s life upside down.

It is sick and disgusting.  I’m outraged with what they have done.  They have done a lot of damage to my life, a lot of which I can never get back.

I’m hoping by winning this judgment, it will show others they too can stand up for their rights.  I’m hoping it will help encourage other attorneys to take these cases and help other people like me.

For now, I am just going to continue the fight because my life and many others have been damaged.

Andersen v  Atlantic, et al, is in the discovery stage.  I hope very much that the courts can see what is being done here and that one day, this type of situation no longer exists.

    it is a victory because it sets a precedent, i am really happy for her and i hope that she wins the case. i hope that they can get rico claims reinstated because i think they are certainly valid and that the riaa are forced to stop their legal campaign of terror.

    It is about time that the RIAA’s campaign of terror was questioned. Too many innocent victims have fallen due to their shoot first and never ask questions policy. I must state clearly here that I AM NOT DEFENDING FILE SHARING. But the RIAA is using shady tactics to persue people with information that may not be accurate. If you don’t believe me, just see the University of Washington study (http://dmca.cs.washington.edu/) were they tricked them into sending DMCA take down orders to innocent computers under their own control and even to a local printer (obviously a false positive).

    Leave it to a woman to topple these goliaths.
    I guess that’s the way it was expected to go – since they prey on women, children, students (except Harvard students), and anyone who is unlikely to be able to hire a lawyer.
