SunnComm (oops, Amergence) loses MediaTechnics

p2pnet news view | DRM:- Amergence Group, formerly SunnComm International, the firm which developed MediaMax, the  infamous DRM rootkit spyware technology which, stashed secretly on Sony music CDs, sparked an international scandal that’s still reverberating around the world, has been dropped by one of its partners.

“Amergence Group received word on Monday, August 18, 2008, that, because of a lawsuit filed in Fresno, California, by its former counsel, Mr. David Kahn, MediaTechnics has announced its withdrawal from the technology deal signed between the parties in June of this year,” says a press statement.

In a much earlier media release, “SunnComm International, Inc., maker of MediaMax, America’s best selling and most accepted content protection and enhancement technology, announced today that certain reports announcing a joint venture with one of its competitors are absolutely not true,” it said, going on »»»

 There are published reports circulating online that state SunnComm is creating a new kind of DRM under a joint venture with a competitor named Macrovision. In part, the story claims:

“From December 1, all iTunes downloads will carry a new kind of Fair Play DRM, a direct negative feedback ‘watermark’ recognized by Fair Play earbuds and, ultimately, by other audio devices from manufacturers who sign up for the code, which was created under a joint SunnComm and Macrovision venture.” The original inaccurate story was written by Jon Newton, editor of P2PNET.net on Saturday, November 5th and can be found at the following online link: http://p2pnet.net/story/6867

When an iPod (or other) user wearing the new audio devices plays an iTunes track not sanctioned by Organized Music (EMI Group, Vivendi Uiversal, Warner Music), Fair Play feedback ‘instructs’ the buds to emit a piercing, high-pitched scream in stereo at 250 decibels.

We thought the spoof was so obviously a spoof, nobody could possibly mistake it for the real thing.

Like, “a piercing, high-pitched scream in stereo at 250 decibels”? It’d blow your head off. ;)

Yesterday, “In response to the decision by MediaTechnics,” SunnComm (oops, Amergence) boss Peter Jacobs (right), “announced regret over the decision, stating that the deal with MediaTechnics represented a major opportunity for Amergence,” says the statement, adding:

“However, Mr. Jacobs stated that the Company will continue to focus on its core business involving leading-edge optical media enhancement technology and will continue its efforts to advance its nascent business development enterprise division.”

Optical enhancement? Don’t say SunnComm (sorry, Amergence) has dropped DRM !?!?!?!?

Jacobs described the lawsuit as “akin to extortion” and plans to file a cross-complaint on behalf of Amergence, “seeking substantial damages against Mr. Kahn based on his intentional interference with the deal with MediaTechnics”.

    Actually there are some questions as to how legitimate the deal with MediaTechnics was to begin with. There are suggestions that it is just another sham pump and dump scheme that SunnComm (now Amergence) is famous for.

    Earlier this year Media Technics Systems was acquired by Silverado Financials ….

    and shortly after that, Silverado Financials changed its name to Mediatechnics Corporation.

    However, at one stage (though not when the takeover happened) the CFO of Silverado was Albert Golusin.

    But Golusin originally was CFO of a company called Fan Energy, which changed its name to Quiet Tiger and then to MediaMax Technology. SunnComm took over Fan Energy when Golusin was CFO and Golusin also assumed the role of CFO of SunnComm. He also became CFO of Dstage (now known as Camelot Entertainment).

    All of these companies; Fan Energy / Quiet Tiger / MediaMax Technology and Dstage were at one time or another involved in pump and dump schemes with SunnComm. These deals have been detailed in another P2PNET article, SunnComm to MediaMax Technology Corporation: A rose by any other name?

    It seems highly suspicious that another company that has an association with SunnComm through a common CFO would have entered such a deal for reasons that are different to the above companies. Why would any company enter a deal with the Amergence Group, considering the Amergence Group is broke, has been evicted from its Phoenix premises earlier this year for non payment of rent, has lost several lawsuits and has been unable to pay the fines imposed by the courts, has no employees other than its CEO, Peter Jacobs, and has a technology that has been completely discredited in the market and would be a liability if used on any commercial CD.

    The actual text reads…

    The Amergence Group plans to vigorously defend against the lawsuit and has retained local counsel, Mr. William McLaughlin of the firm, McLaughlin Sullivan, LLP of Fresno, California. Describing the lawsuit as “akin to extortion,” Amergence’s counsel stated that, in addition to responding to the complaint, he intends to file a cross-complaint on behalf of Amergence seeking substantial damages against Mr. Kahn based on his intentional interference with the deal with MediaTechnics.

    So U can see it was Mr. William McLaughlin, current counsel for Amergence, that describes the lawsuit as “akin to extortion”.

    silverado financials aquired media technics systems in febuary of this year the CEO of SLVO is Ari Bass. and the CEO and founder of mts was Rick Wilson who now serves on the Board of Directors and has taken the role of CEO from Ari Bass.
