Pystar vs Apple — case dismissed
p2pnet news view Products | Freedom:- The anti-trust lawsuit brought against Apple by unauthorized Mac clone maker Pystar has been thrown out.
Pystar’s Mac Clone looked like being the answer to the long-standing and ongoing Apple Mac exploitation, p2pnet posted when news of Pystyar’s Mac-alike first broke.
The company was advertising a $400 ‘OpenMac” Leopard compatible Mac built from standard PC-parts.
Apple was not amused, eventually suing Pystar, whihc turned around and counter-sued Apple, saying its allegations of copyright infringement were “misinformed and mischaracterized”.
Now, however, the dismissal of Pystar’s claim means it may have to, ” face up to Apple’s suit that alleges it is violating Apple-owned trademarks and copyrights,” says the Mac Observer.
US district judge William Alsup gave Pystar 20 days to amend its claim and stated, “Plaintiff must plead its best case. Failing such a motion, all inadequately pled claims will be dismissed without further leave to amend.”
