Even if the person who posted the images was a McDonalds employee (manager or otherwise) only that person is responsible for his/her actions if such actions are unrelated to the business of McDonalds. Of course under the American legal system judges are frequently arbitrary and influenced – or paid off – by lawyers who are their friends, former partners, members of the same bar or who studied at the same schools, etc. As they say, anything goes.

An opinion is that the whole could be a scam to get a few bucks from McDonald and the McDonald employee who posted the images could be part of the scam. A lawyers could also be part of the scam, as well as the judge who will get the case (that can be arranged too).

If it was an employee then maybe McQauks is liable and so is employee. If it was a customer Sherman’s are probably SOL, even though person should not have posted private stuff.

Now to be stupid enough to loose your phone, unlocked yet, is well … stupid. Even if it was locked the security on most phones is easy to break … for some PPL anyway

This is what happens when the people don’t insure/demand that corporations provide top notch security to insure privacy as required by law and mainly by human rights

actually the stupidest thing is he didn’t race back to get the phone.
I would leave something like that in someone else’s possession.
also this was the act of a teenager who didn’t have the maturity to handle the situation properly.

So they moved to some place where there is no Internet. They must be living among the gorillas in the Congo.
As to the other things, it is all self inflicted because of the negligence.

Also, taking pictures of oneself in the original state is a pretty dumb act. Suing McDonald – who cannot be held accountable for the personal and non business related actions of their employees or customers – is an even even dumber action that only benefits two lawyers. And, if someone had to be sued it is the wife that should have sued her husband because HE was negligent in loosing the cellphone.
