Share The Wealth: Part IV

p2pnet news view MPAA | RIAA | P2P:- The Evil Empire comprises:

  • The Recording Industry Association of America (RIAA) , the trade group that represents the vested interests of Vivendi Universal (France), Sony BMG (Japan and Germany), EMI (Britain), and Warner Music (US, but controlled by a Canadian) and their shareholders; and,
  • The MPAA, short for Motionless Picture Association of America, the organisation owned by Time Warner, Viacom, Fox, Sony, NBC Universal and Disney, will let nothing impede their relentless campaign to stamp out any form of competitiveness.

In their views, legal evidence notwithstanding, human rights are irrelevant and actual proof of alleged wrongdoing is unnecessary. Criminal activity, illegal investigation and abuse of the legal system are all perfectly legitimate ‘means to an end’. They don’t even care if you are dead, you’ll be driftnet’ed in pursuit of copyright infringement and the dollar value they can squeeze out of it.

They coerce ISPs, telecom carriers, legislators, main stream media outlets and even judges to be their enforcers at the expense of taxpayers’ dollars.

Listed below are a few examples of how Evil Empire draconian tactics shore up their dwindling market share to offset their lack of quality ‘content’ and inability to embrace a digital distribution avenue.

They purposely put copyrighted material on P2P in order to extort more money from printers, innocent people, poor, elderly, homeless, and even dead people.
Not enough people to sue? Flood the system to increase infringement.

The Evil Empire isn’t satisfied with legitimate copyright infringement: they seed torrents with crap, then claim infringement due to only the filename.

Can’t find enough actual infringement? Fabricate it.

The Evil Empire also floods bittorrent board with trojans, viruses and DDoS attacks via their enforcement arm called MediaSentry.

They even build their own trackers to make it easier to locate copyright infringement.

Who us??

Or they directly infiltrate private torrent sites to build infringement cases.

Evil Empire ninjas?

The Evil Empire voraciously pursues defendants, knowing full well they’re innocent. Primary infringement didn’t work, so let’s pursue secondary infringement on the same evidence, present it to another judge so as not to link them together, and potentially for a better outcome.

We don’t really care if you’re innocent, pay up

Ideas like DRM (Digital Restrictions Management), the vehicle in which the MAFIAA dictates what you have access to, and on what you have access to play it on, is in itself a bad idea, and quickly leading to the demise of The Evil Empire. (Steve Jobs quoted.)

DRM, its how we fuck you after the sale

After being ostracized in Germany, Zuxxez Entertainment (Karlsruhe, Germany yet registered in Switzerland), moved their operation to the UK and never missed a step. It is the business model now to develop useless software, copyright it, upload it to P2P.

Copyright lawsuits pay better than software development.

Then sue anyone who didn’t buy it.

The Evil Empire builds its own software gadgets, based on P2P software to create an ‘evidence gathering application’. Did they get a copyright infringement waiver from the original software designers??

Thanks Shareaza!

The Evil Empire spends considerable amount of time creating intristic algorithms to calculate infringement losses.

1 second = 1 download

The Evil Empire coerces main stream media into buying their outlandish claims.

..resulting in millions of pounds of losses to copyright owners,

The lies, the whole lies, and nothing but the lies.

They even attempt to capitalize on the whole P2P craze by offering awesome speeds to potential infringers. Isn’t this the same ISP that rolled over to The Evil Empire upon request?

Even Wal-Mart sees the money potential.

Download here!

The Evil Empire violates your rights of privacy to ensure a revenue stream from copyright infringement. In Germany, Britain, France, Italy and anywhere else where the courts will allow it to get away unscathed.

You have a right to buy our ‘product’, nothing more.

The Evil Empire doesn’t even care if you’re law enforcement, a mechanic, a non-profit organization or even a children’s daycare.

Offering ‘elevator music’ is infringement, Pay up!
Listening to the radio, violation, pay up!
Singing christmas carols in non-profit establishment, violation, pay up!
Despicable children violating copyright, pay up!

You can’t make stuff like this up.

Including The Evil Empire’s double standard.

You cant use our tactics on us! No Fair!
Evidence? we dont need no stinking evidence.
We just make up actual damages, no need for proof.
Fuck you very much, looking forward to future ‘business’ together

I could go on all day, but my point is that instead of pursuing a digital distribution business model, the labels and studios have in fact found a much better revenue model.

The Evil Empire’s over amplification of the file-sharing impact, to the over inflation of statutory damages, to the serious lack of actual evidence to prove infringement all goes to prove one point.

It’s more cost effective to implant situations of copyright violation and proceed with legal avenues that circumvent our rights to enforce their draconian views to turn a profit, than to actually create popular content that end-users are willing to purchase.

“One has to actually hear a song to influence a decision to purchase said song.”

The Intellectual Property laws are not only ineffective, they’re designed to actually subjugate innovation and competition. To suppress fair use because of alleged lost revenues.

Not only can you NOT allow a friend to listen to your physical media, The Evil Empire wants you to buy several copies of said media for each and every device you own that could potentially allow you to play the media you bought and mistakenly think you own.

They’re even pursuing legislation to tax home theatre systems because they could be used to circumvent a sale and contribute to the ‘Conspiracy to Defraud the Music Industry’.

Did everyone know there’s already a ‘pirate-tax’ on every blank CD, DVD, Blu-Ray disc sold, because it could potentially be used for copyright infringement?

“Excuse me sir, you’re under arrest for purchasing an automobile. This vehicle could potentially be used for vehicular manslaughter.”

In a world where the majority voice tends to steer the future, I implore every reader to STOP buying media from The Evil Empire. Instead, find yourself one of the many P2P avenues to acquire the content you desire. File-sharing networks typically have DRM-less equivalent quality, advertisement free content, and a larger variety to choose from. Let the voice of the majority be heard, loud and clear. Dylan Thomas, “Do Not Go Gentle into That Good Night”. Tell The Evil Empire, in one strong voice, to go get fucked.

The Evil Empire has been posting quarterly losses of staggering proportions, let’s continue to support this trend.

One last offering: Stay away from P2Ps like Limewire and Kazaa. The evil empire has probably already forced them into collusion (including the source code) in efforts to thwart file-sharing using these protocols.

File-sharing is here to stay.  So you might as well enlighten yourself concerning ’safe’ use by circumventing Evil Empire tactics in prosecuting the uninformed, uneducated internet users of today.

I would like to point out one of those items that the major labels want to reserve the right for themselves but not for the artists they represent. It might give Jon or you a topic for some future date if you want to get into it.

For the first time, Atlantic has made more money for music sales this year by digital sales than for physical media.

    http://www.p2pnet.net/story/17701

At the same time, song writers have a contract that they will be paid for the digital download. However not the same for the artist. The on line sales is far lower than the physical media rate for payment of royalties. Plus they want the ability to assign a promotional tag and get out of paying anything to the artist at all.

So an artist could have their total album claimed to be promotional, the labels would be paid, the songwriters would be paid, but the artist would not get one cent out of it. Talk about representing your artists and thievery in the same sentence.

I am positive without proof, that this was on purpose with an eye on the future, knowing that digital is to be the next format to replace the cd.

good point, I had planned to do an article on the financial breakdown of profits funnelled into The Evil Empire in the future. This is good info, I noticed this information on ArsTechnica while doing research for this article.

    Thanks for the post.

this is a much better article Jon
    thank you ;)

here is a perfect example of how the MAFIAA just can’t get it right. Instead of rolling out DVD sales the DAY a movie opens to rake in even more astronomical profits, they trickle out content at their leisure.

Quantum Of Solace, MGM and Sony worst James Bond movie in the history of James Bond movies opened in US on Nov 19th, or so, raking in over 70million/usd its first day. Now, there is a DVD screener (screener is an industry supplied DVD copy of the movie specifically for insiders to review the movie for placement, and awards reviews. Thanks again to insiders in the movie industry.) already circulating the darknet of P2P communities, with the inclusion of ‘For Your Consideration’ pasted over the bottom of the screen. Again, this only goes to prove that people will get what they want in this digital age, regardless of what The Evil Empire dictates. I am already watching this DVD screener, and I tell you, when it comes to James Bond movies, I thought the Peirce Brosnan versions were bad, this one brings bad movie to a new high. Lost sale? my ass, I would NEVER have gone to pay to see this garbage, and I would never have found out how bad it was if it wasn’t for the darknet. The main stream media keeps quoting the dollars its raking in, did any of them review the movie? or even go see it?

Yet the sheeple keep lining the pockets of these dinosaurs by going to see garbage content spat out by the MAFIAA.

    p.s. –> freeman, I wrote the article above :)
