The Recording Industry is in the process of bringing to bear the full might of its combined lobbying and litigating power. And one defendant, Joel Tenenbaum, is fighting back with the help of Leading Internet lawyer and celebrated Harvard Law Professor Charles Nesson and a team of his students.
This is our story.
Tenenbaum, a graduate student at Boston University, was accused by the RIAA of sharing seven songs on the Kazaa file-sharing network in 2004. The Digital Theft Deterrence Act, the law at issue in the case, sets damages of $750 to $30,000 for each infringement, and as much as $150,000 for a willful violation. That means Tenenbaum could be forced to pay $1 million if it is determined that his alleged actions were willful.
At some point, the fallout from the early years of music download from file sharing will need to be settled once and for all. This case is positioned to be the one to make it to the Supreme Court.
