November set for Sharman trial

p2pnet.net News:- Kazaa owner Sharman Networks could be in court by November.

Justice Murray Wilcox has set a "tentative" trial date of November 29 and said directed discovery and affidavit proceedings should be completed by October, states a ZDNet Australia story here, continuing:

"Wilcox also dismissed a range of procedural matters that had been raised by Sharman Networks regarding access to evidence seized from its offices and from affiliated parties earlier this year."

In February, Big Music’s Aussie enforcer Music Industry Piracy Investigations (MIPI) raided the company, as well as Brilliant Digital Entertainment, looking for evidence to back up its case against the firms.

Sharman tried but failed to the negate court orders which allowed the raid.

The material is currently being held by an independent law firm.

A range of procedural matters were raised regarding access to evidence seized from Sharman Networks and affiliated parties earlier this year, says Abby Dinham’s story, going on:

"According to Wilcox, the operation was not carried out ‘behind the backs’ of the operators of various raided premises," and in further response, told Sharman lawyer Robert Ellicott, QC, "with all due respect, you haven’t produced any evidence from anybody".

Wilcox added: "Frankly, I think the whole thing is a distraction from the case."

Both parties are expected back in court on July 16 to present the outcome of talks on procedural issues confronting them, says ZDNet.
