Spider-Man 2 vs Fahrenheit 9/11

A 16-year-old in California was arrested after a projectionist with night vision goggles spotted the teenager using a camcorder during a Spiedy 2 showing and could now be labelled a ‘criminal’.

The LAPD arrested him and took him to Devonshire Division for 10 hours in Adult Prison Cells and then to Juvenile Hall for arraigment, said a p2pnet reader. “Poor Little Guy got the Abu Garaib Treatment. For being stupid.”

The Feinstein / Cornyn Artists’ Rights and Theft Prevention Act (S. 1932) demands new federal crimes for the unauthorized recording of movies in cinemas or other venues, and for “other acts relating to copyright infringement”.

As things are at the moment, under some current state and local laws, cinema owners or employees who ‘arrest’ someone they suspect is using a camcorder to copy a movie could be liable in criminal or civil actions.

However, if Feinstein and Cornyn get their way, theater owners and employees would be legally able to ‘detain’ anyone they thought was trying to illegally record a movie with complete immunity from any civil or criminal liability that resulted from the ‘detention’.

The (ART Act) carries up to $250,000 in fines, three years in jail for first time ‘offenders,’ five years if they’re caught distributing for profit and 10 years inside for repeat offenders.

Compare this to the fact that if you assault someone with a dangerous weapon, the worst that can happen is that you could wind up in a state jail for up to five years, or be fined not more than $1,000; or, imprisonment in jail or a ‘house of correction’ for no more than two-and-a-half years.

Copying a movie = $250,000 and 10 years

Assault and battery with a dangerous weapon = $1,000 and five years

Something is wrong with those equations.

p2pnet readers have a few thoughts on the subject:

Cinema goer: I wonder how many Projectionists took the goggles home. And how many will be caught using those to look down chicks tops and up skirts during Movies … All Movie goers should be concerned that $15.00 an hour projectionists now have night vision goggles to play with (on every teenage boys wish list). Movie theater staff could be viewing people inappropriately in a darken movie theater.

Cinema projectionist: You should see the fun stuff we see with our goggles. They distributed them about 6 months ago. The late night showings are the best.

Perhaps a few people should bring Camcorders to the show – and NOT record – but rather watch your home movies on the camcorder while the show is on. I wonder if the night vision goggles can tell the difference between someone recording a movie and someone watching home movies on the screen on their camcorder. I wonder if using a gameboy during a movie would have the same effect?

Bloody good idea! Make sure they aren’t loaded and that there are no batteries and then just mess with them in as suspicious a manner as you can manage.

Its ok to have batteries and even a tape … just make sure that the unit is not recording and your ok.. the minute they fuck with you its lawsuit time …. and in Cali that means suing the Movie Theaters and the Projectionist Union.

The ideal situation is to have hundreds of moviegoers all bring toy cameras – or anything that looks like a camcorder through nightvision lens. Then let them try to pick out any real ones. At the same time the actual camcorder user will be using some type of disguised spy camera – maybe something like a pen-on-the-ear camera. So while all the decoys get dragged away, the real culprit is safely recording away.

    Why anyone in a proper state of mind would take the time to not only download a ‘camcorded’ version of a movie, but then actually sit at their computer and watch it, is beyond me!
    The sound and picture quality sucks, to say the very least. To me, the ones I have seen are not at all watchable.
    The only thing that this method of piracy does is to give the viewer a general ‘idea’ of the story. For an effects filled movie such as Spiderman, I’d compare the online version to an old scratched up 45. Who needs it! If I want to see the movie, I’ll go see it, or I’ll wait for it on DVD (where there be all sorts of extra stuff).
    It’s not the kids videoing the movie at the theatre that the problem, it’s the ‘insiders’, the people that work for the movie companies, they are the ones that release ‘perfect’ copies. Fining anybody anything for taking a crappy video of a movie should be dealt with by nothing more than a humiliating laugh!

    Don’t be a thief and you won’t have to look over your shoulder in the theater. As far as I am concerned, steal a movie….lose a finger. Do something more constructive with your time than figuring out ways to sue…….you are so ignorant that I have the comfort in knowing there will always be people like you around to clean my toilets.
