Jackson Browne v John McCain copyright case

p2pnet news view | Politics:- US presidential wannabe senator John McCain upset Paris Hilton by comparing Barak Obama to her (and to Britney Spears). He suffered the consequences when  her handlers turned it into a massive YouTube-based PR stunt aimed that “wrinkly, white-haired guy“.

“Paris produced a hilarious spoof that’s been viewed to millions of times and is still going strong,” as p2pnet said at the time. “It must be doing wonders for McCain`s image.”

In the same story, we noted Jackson Browne was suing McCain for copyright infringement and while the Paris Hilton debacle is today but a distant memory, the Jackson Browne  allegation isn’t going away.

McCain (prophetically) used Browne’s Running on Empty during the presidential campaign, and Browne sued him for it.

Now, “a judge denied motions filed by Mr. McCain and the Republican National Committee to halt a lawsuit brought against them by Mr. Browne, according to court documents,” says the New York Times, adding:

“Mr. McCain and the R.N.C. had argued that First Amendment and fair-use rules permitted the use of the song because it occurred in a political context, but Judge R. Gary Klausner was unconvinced; Judge Klausner also set a late April date for a hearing to set a schedule for a jury trial.”

    While I agree he hasn’t really broken new popularity ground with any new releases (I haven’t heard them so I can’t comment on content quality), this is actually a good thing. When politicians are being sued for copyright infringement it makes me think they are suffering at their own hands. If they would have thought the DMCA through a little further, questioned the claims of projected losses, and simply recalled the industry’s stance on technological advancement and how they fought but later profited insanely from it once they adapted.

    My hope, fair use prevails or they do get sued and McCain pushes Congress to adjust the DMCA and copyright laws in general.

    I like to see it when a policy implementer suffers under the policies (s)he made into law! Immunity to policies should be abolished. If only our former security minister would follow his own policies, at least then he could claim “Hey, I go through the same harassment at the airport too.”

    Shows how uninformed and out of touch McCain and his people were. Using a well-known liberal’s material in their campaign! What did they expect? And he wanted to make decisions for the the US and the world. Could you imagine the trouble he would have gotten us in!!!
