   Sad to say, but I predicted this:

   1. NOT particularly sad about the TPB &quot;decision&quot;, because guess what?  There HASN&#039;T actually been any &quot;decision&quot; in the legal sense of the term.
   We don&#039;t usually think about it, but there&#039;s this thing called the &quot;appeals&quot; process which boils down to: the only way this &quot;decision&quot; actually does come into force is if the TPB guys lose their appeals.  Here&#039;s the critical paragraph from the torrentfreak article that I&#039;m pretty sure everybody missed:

&quot;Sunde has already explained that this decision does not mean the end of the line in this case. There will be an appeal which means we are still far away from the ultimate decision - possibly years away. Any appeal from either side must be submitted to Sweden’s higher Court by 9th May 2009.&quot;

    Now, it may just be my own cynicism, but it&#039;s looking more and more and more like there&#039;s at least a significant minority of p2p &quot;advocates&quot; who REALLY don&#039;t want to win.   That&#039;s right: there&#039;s a real draw to the notion of a Quixotic struggle against insurmountable Corporate power&quot;, and all that.
  
   1. We shouldn&#039;t expect any better from the MAFIAA, but that they&#039;d put out a glowingly-cheerful press release over this non-story (even though they know full well that the really important stuff happens during the appeals process, where stuff can -- and often is -- reversed.)
    So realistically -- from a legal standpoint -- NOTHING has been &quot;decided&quot; today.  The REAL &quot;decision&quot; either happens in May (if the TPB guys are stupid enough not to appeal), or if/when they lose the final round of appeals, which -- as Sunde stated, could be &quot;years away&quot;.

   That&#039;s how &quot;legal systems&quot; work, folks: their tortuously slow and complicated (which is why lawyers make so damn much money).
   
   2. The MAFIAA are also counting on the fact that by the time something really DOES happen with this case, we&#039;ll have &quot;moved on&quot; to something else, so we won&#039;t be watching when/if it gets reversed.  That&#039;s how they got away with claiming to &quot;win&quot; the Jammie Thomas thing.  

   Now, I can understand how the MegaCorps would fail to think long-term (that&#039;s what corporate capitalism IS -- maximum short-term profitability, without having to bother with such &#039;externalities&#039; as pollution or destruction of the public domain or etc.), but what I can&#039;t understand, and will NEVER understand, is OUR side falling into the same trap:

   Mark my words: we&#039;re gonna see a short-lived flurry of indignation over this now, but almost nothing about it later, when it really counts (during and after the appeals process).  I think that&#039;s shameful.

   We won&#039;t see anything about this by then.  
   Short-range thinking triumphs, yet again.</description>
