Lying RIAA files more than 60 new cases

Mitch 'The Don' Bainwolp2pnet news view | RIAA News:- You know how RIAA boss Mitch ‘The Don’ Bainwol (right) claims his Vivendi Universal, EMI, Warner Music and Sony Music extortion outfit has stopped filing new lawsuits against innocent people?

He’s a liar, said p2pnet in March, going on, “He and Vivendi Universal, EMI, Warner Music and Sony Music extortion unit, the RIAA, come out with one falsehood after another to be faithfully, and without question, repeated in the mainstream media.

“The most glaring recent example was when Bainwol used the Wall Street Journal to bolster a claim he`d made in August, 2008, that the RIAA had abandoned the bizarre sue ‘em all marketing campaign it`d been running on behalf of its owners, the Big 4 record labels.”

Last week, “Just for the heck of it I took a look to see whether the RIAA had filed new cases against individuals in April, in the Eastern District of New York and Southern District of New York,”  said Recording Industry vs The People‘s Ray Beckerman, adding:

“I found 1 in the Southern District, 2 in the Eastern District.

“So it appears that their representation to Congress that they had ‘discontinued initiating new lawsuits in August’ was a total fabrication.”

Now, “Based upon a quick examination of the records in PACER, I detected 62 new cases brought by the RIAA against individuals in the month of April alone,” says Ray, going on »»»

In December, 2008, they had represented to Congress that they had “discontinued initiating new lawsuits in August [2008]“.

The RIAA has been justifying its lie by saying to news media that it didn’t mean it had stopped filing lawsuits, it only meant that it had stopped filing its John Doe pre-action discovery lawsuits. And the media have repeated that statement, apparently without investigating its veracity, or corroborating it with the RIAA’s attorneys. I decided to look at September 2008 and see what the RIAA’s “John Doe” cases look like, and there appear to be a number of such cases in September alone. Here is a sampling; I’ll be adding to it as I find the time (if there are volunteers out there who want to help me with this project, please email me. Thanks):

The above is just a sample.

Then I started looking at October.

I quickly found:

Capitol Records, LLC, et al v. Does 1-4 D Kansas 6:08-cv-01340-MLB-DWB (filed 10/31/08, two months after Mr. Bainwold told Congress he’d stopped initiating new lawsuits)

Then I ran out of time.
