Morpheus, Grokster win p2p fight
p2pnet.net News Feature:- The battle between Morpheus (StreamCast Networks), Grokster (Grokster Ltd) and Hollywood is finally over with the two p2p companies the clear winners.
Before the US Court of Appeals for the 9th circuit was the question of whether distributors of peer-to-peer file-sharing computer networking software could be held “contributorily or vicariously liable for copyright infringements by users.”
The conclusion?
“Under the circumstances presented by this case, we conclude that the defendants are not liable for contributory and vicarious copyright infringement and affirm the district court’s partial grant of summary judgment.”
“This ruling represents a hard-fought victory for not only Morpheus, but also for our fellow p2p developers,” StreamCast networks ceo Mike Weiss told p2pnet just after the decision was announced.
“It’s a victory for American innovation. Perhaps more importantly, history will show it’s a bigger win for the entertainment industry which, hopefully, will now embrace new technologies like those that power Morpheus to seek new opportunities for artists and creators in the digital domain rather than spending their time and money trying to stifle innovation.”

hallelujah. a great big thanks and props, homeslice, to any and all respective dieties watching from on high for at least this one small symbol that some sense of democracy exists in this land. no matter where you stand in ‘big biz/industry versus the consumers/little ppl,’ this is a nice display, even if it is either temporary or just token, that certain models of trade can and do change. and yeah, cary, hilary, and the rest of you mouthing words about ‘artists not getting their due…’ feh…what jokes.
sitting atop pyramids and lording over ‘owning content’ while squawking about ’stealing from the artists.’ a lot of us artists know exactly what you guys make vs. what the creators of the content actually get, and you barons and nobility of the respective media fiefdoms are witnessing what happens when the people who own the trade routes are suddenly sidestepped and become relics. heard a cutup thang/audiocollage recently, and can’t remember exactly (think it might’ve been Negativland?) with the last quote in the song coming from the 1936 flick ‘The Petrified Forest,’…a perfect little ditty for the CEO’s to think about as they keep playing their fiddles and mouthing such profound, sincere concern for the artists… ;P
