Guns’n'Roses vs Skwerl: RIAA update

The RIAA, FBI and Guns’n'Roses wanted Ken Cogill thrown into the slammer for uploading nine unreleased tracks from the band’s Chinese Democracy album to his blog.

Instead, he  was ordered to serve two months of home confinement and a year of parole for breaking federal copyright law, p2pnet reported earlier today.

But that’s not all!

Oh, no!

Skwerl has also ‘agreed’ to  cooperate with the RIAA to produce an anti-piracy message, says Wired.

It’ll be a ‘public [read RIAA] service’ announcement under which Skwerl, “agrees to co-operate fully to prepare a PSA,” says the document, going on »»»

Such cooperation will include, but is not limited to, signing any and all customary agreements relating to the production and use of the PSA. Although defendant will have reasonable input into the content of the PSA, the RIAA retains final say on control over the use, type, and content of the PSA.”

“The government said it produced a ‘reasonable estimate’ and gave the defendant the ‘benefit of the doubt’ in its calculations, which were based on each infringement being worth 99 cents on iTunes,” says Wired, adding:

“The Recording Industry Association of America, however, told the judge overseeing the case that the defendant`s conduct resulted in more than a $2.2 million loss based on a ‘$6.39 legitimate wholesale value” for the nine tracks the RIAA claims (.pdf) were downloaded about 350,000 times’.”

At least Skwerl didn’t get hammered for $80,000 per track — unlike Jammie Thomas, who’s being hi-jacked to the tune of $1.92 million for allegedly sharing 24 songs online.

    after considering the first article about this, one question
    keeps coming to my mind, and I wonder if it ever came to
    theirs…how the hell did this guy get tracks that no one
    “publicy released”??? They keep crying about stuff that
    “magicly appears” on the net…maybe they should be
    shaking down their own people to find out who is leaking
    this stuff!!!
