The Pirate Bay Dutch retrial

p2pnet news view Freedom | P2P:- The Pirate Bay owners won’t, after all, be liable for huge fines of  $42,300 per day if they don’t shut the site down in the Netherlands, as they’ve been ordered to do by a Dutch court.

Not for the moment, anyway.

They’d, “gone over to the attack” in their continuing battle with the Korporate Kopyright Kartels with (retired) TPB spokesman Peter Sunde (left) saying he`d be filing criminal charges against Tim Kuik, frontman for BREIN, the Dutch version of the RIAA and MPAA combined, p2pnet recently reported.

A Dutch judge ordered The Pirate Bay to shut down in The Netherlands after BREIN charged TPB was, “responsible for millions of copyright infringements on a daily basis,” said NME.

Traffic to and from The Netherlands was to have been blocked within 10 days and failing that, company co-founders Gottfrid Svartholm Warg, Peter Sunde Kolmsioppi and Fredrik Neij would have had to find $42,300 per day in penalties.

The men say they have never received a summons, were unaware of the case being brought against them and will appeal the ruling, said NME.

Now the trio are to, “launch a legal challenge to a Dutch court order temporarily banning the site’s activities,” says The Local, quoting their lawyer, Ernst Louwers, as stating he’ll file a summons by August 25.

“The men wanted a new trial so that they could present their side of the story, he explained,” says the story.

BREIN won’t oppose TPB’s bid for a new trial, “but said it had ‘no doubt’ the judgment would be maintained,” says the story, adding:

“The body agreed to the suspension of the €30,000-a-day fine for the month of August, until The Pirate Bay reopens the case.”

    btw, i’m not in nl, sweden, or any country that blocks or is being told to block pbay. my isp doesn’t block any websites.

    The thing I don’t get is how the judge can rule in favor of any party just based on the fact that the other party didn’t show up. Default judgement should ALWAYS be neutral.
    You want to win this case, prove that they are doing the things you claim them to be doing. Do not win by default judgement. Judges wake up. Should I sue BREIN in Finland for FUD and win just because they didn’t show? It seems that the current legal atmosphere I would. I could summon them using twitter and maybe a bulletin board in some obscure corner of the world where it would never see the light of day. No show = win for me. Block BREIN for FUD in Finland and if you don’t I want 60000000000000 € / nanosecond that it’s not blocked.

    the site was displaying that message earlier on, but the tracker was working i downloaded a torrent from iso hunt and could see tpb tracker working, now the site don’t load at all, but i can confirm tracker working
