Beastie Boys win 3-note fight

p2pnet.net News:- The three-note copyright battle between the Beastie Boys and jazz and classical flautist James Newton is over, with the Boys the winners.

Newton claimed he was owed payment from way back in 1992 when the band sampled three notes from his *Choir* for their *Pass the Mic*.

The US Court of Appeal said No, they didn’t owe him.

Newton appealed but the court is sticking to its original ruling.

"We hold that Beastie Boys’ use of a brief segment of that composition, consisting of three notes separated by a half-step over a background C note, is not sufficient to sustain a claim for infringement of Newton’s copyright," the BBC quotes chief judge Mary Schroeder as saying.

    Heh, if it were the other way around you know the Beastie boys would win.

    Well it could be a win-win situation. While the Beastie boys seem to win the lawsuit the flautist gets publicity and may pick up some listeners from people that normally wouldnt have listened to him. Appealing the case means more publicity.
