Ban Psystar forever: Apple

Its new Rebel EFI lets users boot and install any OS on their hardware, it said recently, continuing:

Psystar has decided to take Open Computing to its next level. Psystar`s next step in helping to provide open computing for all will be to begin distributing our Rebel EFI software that will allow users to operating systems of their choosing, including OS X, on their computers —-

The software is available free to download and try, though with limited hardware functionality, it said, pointing out The trial version is limited to a two hour run-time.

Now, “Apple has filed a motion asking for a permanent injunction against Psystar, statutory damages, and attorneys’ fees and costs,” says Groklaw, going on

“Unless Psystar is permanently enjoined, Apple says, it won’t stop. And by stop, Apple means Snow Leopard too.”

For Psystar, “this isn’t the fun part,” says the story.  “Apple’s expert calculates [PDF] statutory damages from copyright infringement at ‘between $1500 and $300,000 and the statutory damages to Apple as a result of Psystar`s violations of the DMCA are between $449,500 and $4,495,000′.”

Psystar received a crushing blow on November 13 when Judge Alsup ruled the company has been infringing on Apple’s copyrights by selling PCs with Mac OS X, and that it violated the Digital Millennium Copyright Act by circumventing the code that binds Mac OS X to Apple hardware.

Apple unsuccessfully tried to convince Judge Alsup to dismiss the Florida case in September, but may have better luck convincing Judge Hoeveler to dismiss the case now that the summary judgement ruling in the California case has been issued.

“The true purpose behind Psystar’s attempt to move the parties’ dispute to Florida is to forum shop and buy Psystar more time to continue its ongoing acts of infringement,” Apple said in its filing.

“If Psystar’s luck in California is any indication, the PC maker could have a hard time convincing Judge Hoeveler that it isn’t shopping around for a more sympathetic court,” it adds.

    Very disappointing.

    Dell has/had a similar “feature” to their CD’s where it would not install any software from CD’s supplied by Dell on anything but a Dell.

    However, I find it odd that Apple would want to bundle their OS-X to only their hardware, unless they have been trying to create some sort of version of OS-X that can be installed on PC’s themselves and Psystar has beat them to it?

    Windows can be installed on Mac’s, though for me I use a virtual machine as I don’t want Windows running native on my very expensive Macbook Pro.

    There has to be a reason Apple is fighting this so hard, they must be working on a PC version of OS-X which could spread the desire for Apple products, in hopes of selling more Mac hardware. Once people get the taste of OS-X they might want the full feature with Mac hardware.

    Other than that, Psystar isn’t doing much more than VMWare or Parallels in that OS-X can be run on a PC, though not in native format.

    Apple is making the same mistake IBM did in the 80´s.

    Also, other main error was to abandon IBM PowerPC architecture and embracing Intel. They did not learn from the Silicon Graphics disaster. Now: Psystar, tomorrow: whoever.

    Ironic coming from a company that got its seed money selling blue boxes ( A device for making long distance phone calls without paying for them ).

    Steve doesn’t like anyone messing with him. You mess with the bull, you get the legal horn.

    Besides, only idiots are willing to spend thousands of dollars on computer hardware and an operating system. You can build a pretty decent system for $300 and load up Ubuntu for free. Ubuntu is a lot more solid, secure and user friendly than anything else out there now.

    It’s just TOO BAD though that Ubuntu doesn’t support full screen 32/64-bit Youtube Flash video or Apple iPods. I’d switch over in a heartbeat!!!!!
