Bring iPod tax back !
p2pnet.net News:- On December 14 last year the Federal Court of Appeal to the Supreme Court of Canada decided the tax set by the Copyright Board on the internal memory of digital audio recorders (think iPod) is illegal.
Now the Canadian Private Copying Collective (CPCC) wants to appeal the ruling, claiming the board didn’t have the authority to impose a levy on memory permanently embedded in digital audio recorders.
Since December 12, 2003, it’s been collecting a levy on non-removable memory, including both flash memory and hard drives, in digital audio recorders.
The levies set by the Board were $2 for non-removable memory capacity of up to 1 Gigabyte (GB) in a digital audio recorder, $15 for memory capacity of more than one gig and up to 10, and $25 for more than 10.
“Creators of recorded music deserve remuneration for the use of their work,” says CPCC chairwoman Claudette Fortier. “It is our responsibility to uphold that principle even when new developments in technology change the ways in which Canadians make private copies of music.”

what moron allowed such a rate structure?
anyone who knows moore’s law knows what this REALLY means over the long run is that EVERY memory based player will be taxed $25 regardless of how cheap it is.
There is a forseeable future in which hard drive based players with 15 gigs of memory are tossed into bargain bins at the supermarket and cost little more than a can of soup. In such a situation, moore’s law has been successfully leveraged to assure a several THOUSAND percent royalty.

Actually I think you miss the point of what’s going on. The fact that the tax has been removed is actually bad for consumers. By removing the tax on the iPod, this gives the music industry in Canada leverage to justify suing citizens since they can claim that they are no longer being compensated. The whole concept of the taxes was to prevent the catastophe that has eclipsed the US with the RIAA suing every average Joe out there.

From a conference held recently in Ontario. Copyright Board General Counsel Mario Bouchard said, “Richard Pfohl says the recording industry has lost 1/2 Billion in the last five years. Assuming this is true what he is refering to is the manufacturers suggested retail price on a CD. The Copyright Board determined that there is $2.25 in copyright on each CD. If you boil down that $450 Billion you get $50 Million in lost copyright. The copyright board has collected $30 Million a year.”
I think the industry is well compensated already and compensation really isn’t the point for CRIA and others – they want to control the distribution of music which is a whole ‘nother kettle of fish.
