MPAA slams door on LokiTorrent

p2pnet.net News:- In what has to be one of its most blatantly provocative and contemptuous acts yet, the MPAA (Motion Picture Association of America) has closed the LokiTorrent BitTorrent site and the LokiTorrent info with the image on the right, with another graphic under it which reads:

There are websites that provide legal downloads. This is not one of them.

This website has been permanently shut down by court order because it facilitates the illegal downloading of copyrighted motion pictures. The illegal downloading of motion pictures robs thousands of honest, hard-working people of their livelihood, and stifles creativity. Illegally downloading movies from sites such as these [sic] without proper authorization violates the law, is theft, and is not anonymous. Stealing movies leaves a trail. The only way not to get caught is to stop.

The MPAA doesn’t say whether or not the court order also gave its owners, Disney, Fox, MGM, Paramount, Sony, Universal and Warner Bros, permission to use what’s presumably a domain name still owned by another entity in this way. And if it did, how was this ‘permission’ framed, precisely?

But what else can you expect from a multi-billion-dollar industry which wants to use mothers and fathers as surrogate cops and which is reporting truly eye-popping, record-breaking revenues as it tries to claim file sharing “robs thousands of honest, hard-working people”?

UPDATE: LokiTorrent admin Edward Webber has agreed to, “not only pay a substantial settlement with even greater financial penalties for any further such actions, but by Court Order must provide the MPAA with access to and copies of all logs and server data related to his illegal BitTorrent activities, which will provide a roadmap to others who have used LokiTorrent to engage in illegal activities.”

    The fun thing for mp3 it that in europe the laws are not really the same, and some european countries like France, have artists that are fighting against legal attacks from big companies on users.

    While big name acts here in the states sign petitions against P2P. Some artist over in Europe (apparently that’s the land of the free now) have chosen to take a different course of action. The A.P. is reporting that dozens of French artist have signed a petition in protest of the music industries crack down on peer to peer sharing of digital music files.

    It’s amazing how different things are shaping up on both sides of the pond. While artist in the States willingly, or are forced to back the R.I.A.A.’s assault, European artist are siding with the people against the International Federation of the Phonographic Industry. Who would have thought Americans would be looking to the French to find an example of standing up to a bully.

    The question is now really are p2p networks dangerous for the bigs corporations ?

    mostly 99.9% of mp3 are completely illegal, only very few companies propose legal mp3s at fair price. But does it means if you download a thing the big company is loosing money ? not really sure as most users dowloads older music files, which are not located on your nearest reseller.

    Most people are even buying things legally if the stuff is good enough for them. i am not really sure the MPAA or the RIAA is loosing money as they all have huge income !

    Look at all the mp3 players like ip pod, dvd players, home and dvd recorders huge broadband connections competion etc…

    They are all designed today to play illegal file formats and tons are selled.

    (the same shit occured in the 70’s with the radio and the audio cassette invented by philips, the majors said we loose money and every year they get more and more)

    Just Imagine a world where there is no p2p network, the U.S
    gouverment will loose billions in taxes.

    why the governments does not forbid selling stuff which are able to read illegal stuff as cdr recorder, mp3 and so one ? it is technically possible to create devices that recognise legal formats. The issue is that people will buy less stuff and less taxes goes to government.

    the users will not need huge braodbands connections anymore, and will pay less their isp, they will not buy anymore the millions ipod and the government will stop getting their huge extra taxes.

    The us supreme court should think, before acting.

    U.S goverment know well that their action is done to please MPAA or any audio major.

    The goverment has forgotten to tell you that P2P networks shown as illegal provide to them billions of legal indirect income.

    Do not worry the dogs are only shouting, the judge gave MPAA a bone, to calm down the dogs.

    But like in the 70’s the US does not forbid the cassette, and will not forbid peer2peer nor intenet, as they will loose a lot.

    What a shame as since internet, p2p networks exits , like radio and the cassete in the 70’s the numeric revolution is providing each year more and more income.

    If the MPAA wants to put every user of P2P in prisons the governement should now build up new prisons for the incomming 50 millions of americans.

    The judges should really concentrate their actions on murderers, rippers and so on or even persons making money with their downloads
    instead of fighting by users of p2p.

    The story is reapeating itself,

    sometimes people need to find out quickly a guilty guy to justify their work and existence (like lee harvey oswald)

    but no one will stop to thing 5 minutes to see where all the issue began.

    You will maybe think what i am saying is crazy

    But p2p networks help a lot legally a lot of other hardware corporations and the government with money from indirect income:

    Cisco systems with their routers, as users has getting huger
    broadband connections now due to p2p, your ISP, your video retailler that provides you a dvd device that might belong to one of the MPAA companies, apple with ipod, and so on and so on….. even Sony which
    has colombia has maybe lost some thousands with p2p but (not so sure) but won the video games market with playstation in the 90’s and now just because it were the only video game stuff able to read easily cdr and dvdr stuff.

    As philips won the market in the 70s for the firsts radiocassette player.

    If we start to think and the government also (but it knows it) all the p2p illegal stuff is not so illegal after all and provide a lot of legal income to everybody ;-)

    Hi all, I’ve found myself registering here today as a result of an extensive search trying to find out what has happened to Loki Torrent…. Now I know. Strikes me that the best way to use all that donated cash is to just to set up another site that is (not) Loki torrent. Or is that a cute English anarchist way of looking at it?
    I’m a (mature) student studying IT and a fan of P2P networks for all uses. I have recently been investigating the subject of P2P and downloading as part of a study course. We drew a conclusion that P2P file shareing is here to stay, on the increase and unstopable by courts, Hollywood or any of these groups that oppose it and that ilegal shares will only increase untill the Movie/Record companys promote their material on the Internet as llegal downloads at a price which reflects that there are virtually no overheads and no middlemen involved. £1 a track for music is much too expensive! What do the band recieve + a once off studio and production bill to cover? That is the market value of the download. £1 is a back catalogue album, not just one track!
    If the big players don’t hurry up then they will get sidelined by the sway of social and market change. Any band or film producer is now free to promote thier own work in this way. How many people would still download illegally if the material was available at the correct price llegaly? However untill the industry catch up with the reality these type of confrontations will probably continue to happen from time to time. Comments?

If you had a *COURT ORDER* requiring you to comply and turn over all related logs and information, would you really resist it and go to jail just to preserve an ideal? Hell no! Each of you would turn it over and that would be the end. But yet you find it so easy to blame Lowkee.

    And if you were sued by a multi-billion-dollar consortium, with virtually endless monetary, legal, and political resources, what would you do? Would you spend the $30,000-$40,000 in donations, plus at least another $50,000 of your own money, to pay for the enormous legal expenses involved in fighting the case in court? Or, would you agree to a settlement with the MPAA, pay a fine most likely LARGER than all the donations he collected, and have all of this over with and off your back? The answer is easy — you would pay the settlement and end your troubles. If you are idealistic and say you would fight it, ask yourself if you would be willing to take loans and sell all your posessions, in addition to the donation money, to pay for the extremely expensive legal bills?

    Before you judge Lowkee and condemn him for what you, too, would also do in his situation, take the time to consider what’s going on and what you would do if faced with his situation. the answer is obvious…

    Spoken like the truly ignorant! Since you claim he “narc’d on us”, please explain exactly what he should have done differently. Should he have defied the court-mandated order and gone to jail? Should he have just skipped town and become a fugitive?

    Who care’s if he made a buck or two. Those of us who paid a small fee managed to download a whole load of software/music/videos for evaluation at least. Some video stuff in particular was just too complex to have wasted good money on. I’m happy with what I got out of it, and lookforward to the next ’scam’. We’re not dummies.. we know what we’re doing.. the losers are the ones that pay full price for rubbish software that doesn’t live up to its claims. I, for one, have actually bought the odd retail package to get the updates, manuals, support etc. Roll-On the next ’scam’.

    I think I would make sure that the relevant logs, info etc. had (largely) disappeared due to an error with a computer, as we all know computers are temperamental devices and very good at loosing data, if I was being hassled by an American court then I think a quick accident with a powerful magnet somewhere very close to the server would be a sensible approach.
