Why isn’t Google on RIAA hit list?

p2pnet news view P2P | RIAA:- Canadian indexing site isoHunt is on a hit list dreamed up as lamescream media headline bait by Vivendi Universal, EMI, Warner Music and Sony Music’s RIAA.

It’s being “overwhelmingly used for the global exchange of illegal movies, music and other copyrighted works”, says the Big 4 extortion unit huff piece.

So are the Ukraine’s mp3fiesta, Germany’s RapidShare, Luxembourg’s RMX4U.com and Sweden’s The Pirate Bay, it says.

And so is giant Chinese site Baidu.

But there’s another far more important indexing site the RIAA somehow missed.

Google.

Why isn’t it on there as well?

The Pirate Bay guys may soon be on their uppers, and the feral entertainment cartels are also going after other indexing sites like there’s no tomorrow.

Which for them, of course, is true.

Indexing sites are exactly that. Sites that index. They don’t actually host anything.  They merely point to where something may be.  Or not.

But it doesn’t really matter because the P2P networks are only where it’s at only for a limited number of file sharers, although Hollywood and the Big 4 record labels would like the world to believe they believe that’s the whole ballgame as they try to pretend the Light Nets, as I’m going to call darknets from now on, don’t exist.

In a p2pnet post, Light Nets, “range from simply passing (and mailing) discs around, to WASTE, through trusted friend-to-friend bulletin boards, FreeWAN cells, Freenet-type sites, physical and WiFi sneaker nets of various kinds, hidden sites, and so on,” I said.

And there’s Redbox and other ’services’ which’ll inevitably follow it.

But wait! There’s another indexing site which, from all appearances, is completely safe from the depredations of the Korporate Kopyright Kartels.

    This is the substance of the MGM vs. Grokster supreme court case. Aside from the obvious fact that Google has the resources to take on any comer with years of litigation and millions of dollars in legal fees, Google does not fit all three criteria for the inducement test.

    Namely, it does not actively attempt to market itself directly to known sources of copyright infringement.

    In addition, even though they are an ad driven company, they can probably demonstrate that their biggest market is does not consist of users looking for an alternative to software programs that have been cited for contributing to infringement.

    I know, it’s fun to beat up on Google, however I don’t see anyone but the most foolish companies (like that porn company that sued and lost) taking on Google.

    But Google have so much money that it could acquire the 4 corporations of music parasites in one shoot if it wanted too and make all the vermin on board walk the plank.

    These does not make sense.

    1) The pirate bay is not for profit never was so they were not trying to tap any market. The pirate bay is not even a company. The add are use to pay for the servers hosting and the bandwich a significant expense concerning the traffic. The claim that TBP is making money was a lie. (another one from an industry of liars. We are use to it now.)

    2) Filter are not technically feasible and google is not filtering anything even in China although they were blocking some IP but this is diferent.

    3) Once again the Pirate bay was not and is not making money. This is why it is still standing. TBP does not rely on profit to stay online and shutting it down is impossible.

    Now Google is a for profit company operating an index site not very different from the pirate bay and Google is filtering anything nor is attempting to do so.

    Grokster was a different story.

    Now there is all these open source client/server applications such as Limewire impossible to shutdown because there is no central server.

    Even applications such as Edonkey currently no longer under development is still widely use because it is totally decentralized.

    Now It is clear that nobody is going to follow crappy and undemocratic laws imposed by corporations of criminal parasites nor take seriously any decisions taken by corrupted courts with no credibility.

    As far as I know, The Pirate Bay is not subject to the jurisdiction of The United States Supreme Court so none of that applies.

    In order to shut down Google, a US based company, someone would have to litigate in the US.

    But the same invalid arguments has been use by the corrupted swedisn court and the same invalid arguments has been used again by the corrupted US court against ISoHunt. This still does not make sense.

    You know what? I wish they WOULD go against Google (I hate them both equally). Arrogant companies like these need to be taken down a peg or two. If they went against google and lost, it would be a blessing. Why? Because they would be bankrupted!
