Five Dutch ISPs and Brein
p2pnet.net News:- “Associated press has a funny style,” posts Dutch p2pnet reader Tothbenedek, going on, “Actually BREIN totally lost this round.”
Tothbenedek was referring to the AP story saying five major Dutch ISPs are cooperating with the Big Music cartel against “illegal” file sharing, saying the providers will send warnings on behalf of cartel enforcer to clients suspected of swapping files.
He says Brein can’t compel the ISPs to hand over customer details so what the compromise really means is that the Big Music puppet is using the ISPs in a totally wasted, and expensive, attempt to intimidate customers.
It works like this:
- The Big Music enforcement org gets its messages to the ISPs, who then send them off to their clients – charging Brein a fee in the process. (Nice one ; )
- “The ISPs are happy because the BREIN stops bitching against them,”.
- Brein is happy because, “their stupid lies get to the filesharers.
- And the filesharers are happy, “because they throw the warnings to the trash and continue downloading without any chance of getting sued.”
And actually, “filesharing today became officially” tolerated in the Netherlands today, adds the comment post.
“It exists, but on paper nobody likes it (except for the ISPs and the filesharers whom are staying on a low-profile on this), but nobody can or will do anything against it.”
Brein “could file criminal lawsuits” but Tothbenedek believes it’s unlikely because the law isn’t about filesharing, “and the Netherlands seems to be the most open in files sharing, so it is possible that this court could rule against the BREIN and the message would spread across in every EU country” with similar copyright laws.

When testing/working on a law proposal for adjusting the authoring-law (copyright law) that became law on the first of September 2004, the government made known that there point of view was that a copy should preferably be made from a legal source. Users who use file-sharing services like Kazaa also upload there content, unless they take steps to prevent that happening. It is without a doubt that men would be invading the rights (privileges) of the ones who hold these rights by doing that.
For users of Filesharing-programs such as eDonkey and Bittorent it is even impossible to completely prevent the offering (uploading) of a certain amount of the file. By using eDonkey and Bittorrent the file that youâre downloading is automatically being offered (uploading) at the same time. The function of uploading can not be turned off. The offering of files can be drastically lowered by making sure that you have no other directories opened for the sharing of files.
eDonkey and Bittorrent are designed in such a way that the user gains by offering as many files as possible so that the download speed is influenced in a positive way .
eDonkey- and Bittorrent users who want to download files such as movies, music or computergames at the highest possible speed without offering (uploading) as much as downloading use programs such as Netlimiter, which brings your upload speed down to (almost) zero without this affecting your download speed. You can of course use a leech mod eMule client that does not upload whatsoever. It works. I have tried it. I sometimes use it when I want to free upload speed for something else wothout stopping my eMule downloads. But when not I switch back to the standard client.
