RIAA goes after Google – 111 times

p2pnet view P2P | RIAA:- Since it began its sue ‘em all campaign in 2003, the RIAA has threatened some 30,000-40,000 American families with with spurious ‘settlement’ offers under which it says it’ll go away if the victims pay them upwards of $3,000.

‘RIAA’ is short for Recording Industry Association of America, even though three of its four owners aren’t even vaguely American.

The RIAA services Vivendi Universal (France), Sony (Japan), EMI (Britain), and Warner Music (US, but controlled by a Canadian).

The Big 4 use it to to falsely claim they’re being ruined by file sharers: that files shared online equal sales lost, with “devastating” results for them and their hundreds of directly and indirectly associated labels.

But it only goes after little people who can’t afford to defend themselves.

Ask giant US online advertising company Google.

As p2pnet has pointed out a number of times, while the entertainment cartels assault the likes of The Pirate Bay, accusing them of facilitating online file sharing, they leave Google, the most egregious offender of them all, virtually alone, ‘complaint’ notices notwithstanding.

According to Chilling Effects, for almost a year the RIAA has been sending “Alleged infringement of recorded music copyrights” DMCA notices to Google. They run from August 3, 2009, to July 30, 2010.

It’s had not one, not two, but 111 — that’s one hundred and eleven — notices, and there are also two from February and May, 2007.

The first item on the July 30, 2010, ‘complaint’ is http://beathearts.blogspot.com/2010/07/jazmine-sullivan-holding-you-down-going.html. A Google search shows >>>

“RIAA DMCA (Copyright) Complaint to Google — Chilling Effects …” – says Google.
30 Jul 2010 … RIAA Sent by: VP, Online Anti-Piracy Washington, DC, 20004, USA. Recipient Information: Google, Inc. Mountain View, CA, USA. Sent via: email … www.chillingeffects.org/dmca512c/notice.cgi?NoticeID=43669 – Cached

Jazmine wasn’t there, but http://beathearts.blogspot.com/ was still alive and well at 4:00 am Pacific this morning. So it appears Google may be acting on specific notices.

But “About 439,000 results” flowed from a Google search for jazmine-sullivan-holding-you-down-going.html, and on my second try, I downloaded an mp3 of the song directly from a Google link, no problem.

And there are literally millions of other links to other songs which can be easily and readily accessed through Google search.

Because Google is the world’s premier file share indexing site for everything from movies to games to music to applications.

Which is fine. Or it would be if the rules were applied evenly across the board. But they’re not.

Instead, Google stands as out as the only site of its kind not to be openly and relentlessly attacked at every turn. And to the best of my knowledge, it has yet to appear in court, charged with being a copyright facilitator.

Certainly, none of Google’s executives have been accused of thievery, and not one of their children has been singled out for public humiliation, unlike ‘ordinary’ RIAA victims.

Says the most recent RIAA-to-Google missive >>>

I am contacting you on behalf of the Recording Industry Association of America, Inc. (RIAA) and its member record companies. The RIAA is a trade association whose member companies create, manufacture and distribute approximately eighty-five (85) percent of all legitimate sound recordings sold in the United States. We have learned that your service is hosting the above web sites on your network. These sites are offering direct links to files containing sound recordings for other users to download by such artists as Lil Wayne, Train, Asher Roth, AC/DC, and Arcade Fire. These recordings are owned by one of our member companies and have not been authorized for this kind of use. We have a good faith belief that the above-described activity is not authorized by the copyright owner, its agent, or the law. We assert that the information in this notification is accurate, based upon the data available to us.

We are asking for your immediate assistance in stopping this unauthorized activity. Specifically, we request that you remove the sites or the infringing links from your system, or that you disable access to the sites or the infringing links, and that you inform the site operator of the illegality of his or her conduct.

You should understand that this letter constitutes notice to you that this site operator may be liable for the infringing activity occurring on your service. In addition, under the Digital Millennium Copyright Act, if you ignore this notice, you and/or your company may also be liable for any resulting infringement. Google is an amazing indexing and search site. More power to it.

But why it isn’t plagued by the same vicious and continual harassment as RIAA victims and other indexing sites which do no more and no less than Google.

How come?

“Pirate Bay, accusing them of facilitating online file sharing, they leave Google, the most egregious offender”

I don’t think that Google or the pirate bay are offenders as far as copyright is concerned, the pirate bay even less than Google because the Pirate bay is non profit unlike Google.

thanks to ChillingEffects and DMCA complaints – got a new list source for blogs and D/L’s

  3. Anonymous Says:

Fuck, how is indexing sites illegal… that’s even more fucked up than taking down a site for indexing torrents… Google cant be blamed just because people use it to find illegal shit, you’ve gotta blame the guys who upped it in the first place… Again RIAA is trying to take the easy way out… how about filing a lawsuit against S&W every time someone uses one of their guns to kill a person, makes just as much sense
