EFF, P2P United: p2p hearing

p2pnet.net News- The EFF (Electronic Frontier Foundation) and P2P United offered a joint approach at today’s US Senate Committee on Commerce, Science & Transportation hearing to examine options following the US Supreme Court’s Grokster v MGM ruling.

The two organizations urged the Committee to, “affirmatively embrace two overarching public policy goals,” namely:

1) Proactively protect communications technology innovators in a targeted fashion from the likely chilling effects of potentially crippling statutory liability in the uncertain legal environment created by the Supreme Court’s holding by working to reform existing law in this area.

Under current law, a technologist or technology company held liable under one or more of three theories of secondary liability for what users of its device or software may have done is subject to statutory damages of between $750 and $150,000 for each copyrighted work found to have been infringed. Moreover, the copyright owner is not required to prove that it actually suffered damages at all to receive such awards.

P2P United and EFF urge the Committee to work with other relevant bodies to limit the availa-bility of statutory damages to cases of direct copyright infringement, such as the large-scale bootlegging of music CD’s or other copyrighted material; and . . .

2) pragmatically promote serious discussion of a voluntary collective licensing regime as a principal basis of a new digital music marketplace in which Internet users can lawfully access the broadest variety of copyrighted material using the most efficient and convenient technologies available while assuring the fair compensation of copyright holders, big and small.

Modeled on the system that made commercial radio viable and lucrative for copyright owners in the early 20th century, such a voluntary licensing system would convert millions of presently unlawful and uncompensated peer to peer song downloads into actual compensation for all rightsholders.

The dual reality that P2P technology will now always be with us, and that illegal downloading has exploded even in the face of aggressive music industry litigation, argues for creative and collaborative solutions, as recently endorsed by [Hilary Rosen] the former Chair of the Recording Industry Association of America.

    I’m listening to this… and their still calling filesharring, piracy…

    Its not piracy… Piracy is duplications and sales of copywrited materials… Filesharring(as for what they are talking about) is free (usually low quality) copies of non physical material, and sharring.

    Personally, I think current copywrite laws are atrosious… They give the owners too much power…
    The ONLY thing copywrites should do, is keep people from selling copied materials…

    Downloading music, and games, for free, is perfectly fine! and hasn’t costed the makers ANYTHING… they’re still making the same, better even, profits…

You see money isn’t real it’s just an idea, an agreement in society carried out between individuals and groups of individuals (companies etc). We all prosper so well because we sell to each other. What the entertainment industry provide is optional, we’re not talking about oxygen, food or water here. I have no doubt some people would take all content for free (including newspapers,magazines and novels) but it is not going to be allowed to grow unchecked. P2P does have a future in society, but not as the rabid animal that it currently is. There as some big profile scalps soon to be lost from the P2P networks, prepare for big changes. No free lunches on this planet pal.

    There is a simple solution. We do not have to beg legislators to ignore their paymasters and listen to the voters. We just need to
    make the cartel and government controls obsolete. Yes, it is possible with a bit of work, minimal investment, and a small number of people working together.

    Thanks to ethernet, DSL modems, wireless networking, and other wonderful technologies, it is possible to set up local wide area networks that consists of NO cartel controlled infrastructure. If fact, if enough hackers get together, it may even be possible to have these wide area networks interconnected to form a worldwide independent network. Computers can be both on a local wide area network AND the Internet.

    The Internet can be used to transport information such as instant messaging, email, and other time sensitive information between local wide area networks while local wide area networks can be used to exchange information that is not government or cartel blessed. Mass storage is so incredibly inexpensive that it can be used to transport huge amounts of information between local wide area networks in incredibly short periods of time. A single data cd can hold approximately 144 different songs. Just imagine how many songs a DVDR can hold :-) These DVDR’s can be encrypted and transported between local wide area networks via automobile, snail mail, Internet connection and even over a wireless link.

    50 computers on a local wide area network can hold an incredibly huge amount of music, movies, documents, and other information. 1, 2, or even 3 computers could serve as exchange computers which would allow information to be traded with other computers or networks. When set up properly, this type of network would be ALMOST completely immune to **AA snooping. Software is being designed and written that will provide automatic network protection if and when the governments and **AA’s decide to use paid informants.

    Another solution that goes hand in hand with the local wide area network solution is to make the commercial entertainment cartels obsolete. Most homemade films are still kind of shitty, but I have seen some big improvemnts over recent months. Independent music is in many, many cases SUPERIOR to the commercial offerings. The value of cartel media is declining while the value of much of the independent media is gradually improving. Homemade movies are getting very inexpensive to produce and distribute.

    There are immense opportunities for small businesses to make entertaining movies that feature products produced by that business (works great if it is not overdone). These independent movies can be put on websites that cater to the same interest groups to which the small business caters. The same can be done for independent political parties. Even on the cartel controlled media channels, I find that many commercials are more entertaining than the so called featured program. The great thing about local Wide Area networks is the fact that people will not have to pay to watch commercials by subscribing to overpriced cable and satellite programming.

    For the first time in about 20 years will the small business be able to compete with the large cartels. The large cartels operate by making sweetheart deals with one another to help each other push their products (An example of this is the roaming agreements between the big cellphone cartels. It would be very hard for a new carrier such as Bob’s cell phone company to compete with these giants). Small business will have the opportunity to market to a worldwide audiance while providing entertainment to the masses for free. It is an idea whose time has come. Indie media combined with indie infrastructure is a very powerful force.

    Since when has the government obeyed or even noticed that the Constitution exists? The Constitution has been effectively nullified by the Democrats, Republicans, court system, governments, and most of all, the population which keeps wasting their vote on “the lessor of 2 evils.” They are afraid to vote for candidates from independent parties because they say that “These candidates do not have a chance to win.” I try to research each candidate on the ballot as best as I can before choosing.

    One thing that I strongly consider is how much money they spend on their campaigns and where that money comes from. I would in many cases rather vote for some unknow write-in who has put up paper campaign signs around the area than some loudmouth Democrat or Republican candidate who has spent millions of dollors of cartel donated money. Why do you think the cartels and special interest control the country? It is because we the people keep voting for the candidates that they pay to advertise.

    I quit trying to reach those who faithfully vote Democrat or Republican , because most of them are too brainwashed to think for themselves. I find it easier to convince those who stay home on election day to get out and vote for candidate of alternative parties.
    These are the people who already know the results of voting for the candidates of the two big parties. They understand that one candidate is good as another when it comes to elections. That is why they need to shown that there are real choices (alternative parties) that can make a difference.

    The only non-violent way of getting the government to obey the Constitution is to vote out the corrupt officals that run the country.
    Running on the ticket of the Democratic-Republican party is a strong indicator of where a candidate’s loyalty lies. As far as I’m concerned, the only member of the House of Representatives that deserves to be re-elected is Ron Paul.

    Untill the Democrat-Republican party is voted out of office, we will be fighting a technological war against the government and cartels that wish to stifle our basic freedoms. We will continue to have abusive cartel-purchased copyright and patent laws that will stifle our freedoms. Unless people start taking action, I see the day coming where ISP’s will be forced to monitor and disclose a all of a customer’s internet activities simply on orders of a cartel or government agent.

    We reiterate that we are not talking about food, oxygen or water here. We are talking about the fruits of a entertainement creators labours. The “cartels” as you like to call them dont profess to own the creative process, that insinuation is obsurd. If the p2p networks feel locked out of the distribution process, then let them create their own content. If you all despise the so called cartels so much don’t have anything to do with them or any of thier content. But that’s not the case, you want to have your cake and eat it as well. Because its covenient to turn a blind eye, to stick your head in the sand. Personally I enjoy some “hollywood” movies and think most commercial music is crap. I have no allegance to the industry, I see 99.9999% of filesharing as a clear cut case of right and wrong. I have never met anyone who has used it for a legal purpose. Intellectual property is real, it’s protected by the law of the land the world over. The law is clear if you fileshare copyrighted property you are stealling, breaking the LAW. The P2P industry will sell you all out in the blink of an eye, you may think they are in it for altruistic reasons but they have constantly professed their desire to securely(read DRM) SELL the Cartels products. The P2Pnetwork extortionists have used the “P2P community” as leverage to create their own empires. They don’t give a rip about you. Mr Bram Cohen pubicly journelled his desire to “create digital piracy” he will ultimately hang himself by those disclosures. As for the kazaa ’s ,edonkeys and their ilk, well what a joke. The underlying tech of P2P is very very clever and when it grows up it will come into its own. Until then it will be litigated into shape, laws will be changed if necessary, you watch. The idea of “Utopia” is very appealing but its has no basis in reality. I apologise for calling the kid a “dickhead” it was out of line.
