p2p news / p2pnet:- Jenner & Block is a US law firm beloved by the MPAA, which uses it for much of its dirty work. J&B also gives shelter to former RIAA employees such as Matt ‘The Dentist‘ Oppenheim who, through J&B, now acts as an axeman for the MPAA (Motion Picture Association of America).

Oppenheim was responsible for trying to terrorize Kevin Reid and Ian Hawthorn in the UK, even though the MPAA is a purely US entity. And yet J&B brags about a “100% rating in the Human Rights Campaign’s (HRC) closely watched 2005 ‘Corporate Equality Index’ survey”.

Meanwhile, over at Slyck there’s a hilarious forum post which, although The Dentist isn’t mentioned, does name J&B as the sender of a nasty Cease & Desist missive, signed by its Katherine A. Fallow on behalf of the MPAA and addressed to nukleuzradio.org.

It bleats about copyright infringement supposedly perpetrated by nukleuzradio’s Terra Torrent and makes the usual demands in the usual wording.

But what’s really interesting is the company’s grammar and spelling, to wit:

  • “lisenescs” for licenses
  • “against ‘Does 1-8’ Once” for “against ‘Does 1-8’. Once”
  • “or intent” for “our intent”
  • “infrinment” for “infringement”
  • “individuals” for “individual’s”
  • “members” for “members’ ”
  • “representive” for “representative”
  • “wensite” for “website”
  • “This list does not intended” for “This list does not intend”
  • “messager” for “messenger”

Is Ms Fallow (who suggests a call to her at 202 637-6329 might resolve things without the need for “further litigation”) really that bad? Or is her letter in fact a boilerplate, in which case, who wrote it and who checked it?

Was it Matt?

As SG-ME posts on the Slyck forum, “If these guys can’t even write a simple letter do we really have anything to worry about.”

    Any business person who deals regularly with lawyers can tell you that the general rule holds: 90% of them are idiots. You’ll probably have a good laugh at their bungling incompetence the first time you come up against them in any dispute.

    Just keep three things in mind:

    1. Almost all judges are ex-lawyers, so at least pretend to be respectful when you appear before one.

    2. Your own lawyers may be just as incompetent, so double-check all their advice and everything they do for you.

    3. If it’s an important big-money issue, the other party won’t just drop it and go away - they’ll send in the more expensive A team after you’ve sent the B team packing. Maybe you should have tried to settle with the incompetent B team.

    Perhaps that’s WHY we need to worry. If the mouth breathers have no reasoning capacity they will never listen to (comprehend?) reason. ;-) + :-(
