Alito: new Supremes justice?
p2p news / p2pnet: Having failed in a first attempt to hoist an apparently unqualified, but very Cheney / Bush friendly, replacement for Supreme Court justice Sandra Day O’Connor, the Philadelphia 3rd US Circuit Court of Appeals’ Samuel Alito is next up.
“Technology companies are likely to find Alito an appealing nominee because for the most part he’s “business-friendly,” CNET News has George Mason University law prof David Bernstein saying.
“He’s generally skeptical of open-ended liability, and seems to be inclined to strictly construe contracts, including contracts that dictate where and under what law a dispute will be resolved.”
He’ll also probably take a “permissive approach toward electronic surveillance by police,” says CNET.
Two of his cases, “symbolize the long-running clash of legal philosophies – individual rights pitted against police power – that has often found Alito siding with law enforcement,” says the story.
“A former prosecutor, Alito worked for the Justice Department between 1977 and 1989.
“Alito, however, has stopped short of giving law enforcement carte blanche.”

Not necessarily so. If he is asked during confirmation hearings and answers truthfully and if he copied music on cassettes, thus being an uncharged thief and criminal, per the copyright law as descrobed is in the FBI “you are a criminal” message on DVDs.
Being that the probability that he illegally and criminally music copied is very high, almost 1, he should have very little chance, just as todays kids are all criminal and eventually no one will qualify to be a judge.
After all, all the rampant criminality of copying music did not start with todays generation. It was started by the generation of the now legislators and pilitical leaders, the now judges, the now wealthy, the now business leaders and the now RIAA and MPAA and other cartel bosses.
