Fight Goliath now at $3,678.58

    I’ve had a number of emails asking what’ll happen to the money when, thanks to your contributions, Santangelo has left the RIAA (Recording Industry Association of America) grovelling in the dust.

    Unfortunately, she’s not the only one who’s being victimized.

    In short, Patti is the beginning of the Fight Goliath campaign, not the end, and a non-profit corporation is now being set up to help other victims of the Big Four Organized Music gang, namely Sony BMG, Vivendi Universal, Warner Music and EMI. More on that when we’re a bit further ahead.

    Whatever is left over from the Santangelo case will be placed in escrow and a public board of directors will distribute funds to other victims.

    So put a donations button on your site and help make it clear not only to the Big Four record labels, but also to the movie studios, software companies, and anyone else who needs to learn the lesson, that they depend on us, not the other way around.

      RIAA hasn’t proved that there were any files shared at all. Ms. Santangelo no longer had the computer by the time of the lawsuit. So the only evidence will be the ISP’s logs of who had the IP address at a certain time; and the RIAA’s claims about what was shared on a certain IP at a certain time. All of these are unreliable; they are often inconclusive or mistaken.

      Also, even if the kids were sharing files on her computer, there are substantial questions about responsibility. Ms. Santangelo had only an average degree of computer knowledge, which is very little, and she had actually made efforts to impose controls on the kids’ activities. If a person makes all reasonable efforts, isn’t that enough? Does a parent have to watch a child at every moment?

      Keep in mind that there are other ways to fight this case. What about fighting on whether the FASCIST RIAA’s actions to obtain the identities of ISP customers is legal or not.

      For instance, how about the legality of the RIAA being able to file one John/Jane Doe lawsuit against thousands of anaonymous IP addresses? They should have to file one individual lawsuit against each anonymous John/Jane Doe they sue. Patti also can fight against the legality of that.

      Also, how about fighting whatever way the FASCIST RIAA has manipulated the courts to only notfiy one side the party in the litigation, and not even let the one being sued know. I thought there was some mention of this as well and how the courts were required to notify both sides of the party in cases of litigation.

      Patti Santangelo can fight those two things I mentioned above as well. One has to wonder if her chances of winning on behalf of those things I mentioned above is much grater than her winning on just the basis that there isn’t enough evidence that she did it? Either way, she has multiple grounds to fight this on.

      The Brittany Chan case already set a precedent. The Michigan courts ruled that the mother was not responsible for her daughter’s downloads. Yes, I and most people would agree that parents have a responsibility to know what their kids are up to and exercise due diligence as a parent, but how can they know everything a child does? This is plainly ridiculous. Think back to yourself as a kid, or if you’re a parent, do you know everything that your child does? I did plenty of things that my parents didn’t approve of, and don’t know about. I watched porn during a school trip, bought fireworks, and did some pretty dangerous things

      But then again, the RIAA lawyers don’t have mothers, so how would they know?
