Health care aid new RIAA victim

p2p news / p2pnet: Marie Lindor, a Brooklyn, New York, home health aide, has never bought, used, or turned on a computer in her life.

But she’s still being sued by the Big Four Organized Music cartel’s RIAA in Brooklyn federal court.

Lindor literally doesn’t know one end of a computer from another but according to the RIAA (Recording Industry Association of America) she’s said to have been using an "online distribution system" to "download, distribute, and/or make available for distribution" copyrighted music.

She’s requested a pre-motion conference pending a request for summary judgment to have the complaint thrown out, and to have her attorneys’ fees paid.

    You know their methods of determining who they claim are infringers is fishy when these sort of stories surface and continue to do so. It is the purpose of the **aas to make each think that if they are put on this list that they owe and owe big time.

    The “Settlement Center” is nothing but a collection agency that has been instructed to accept no excuse short of “here’s the money”. So it isn’t a Settlement Center, inspite of the title, its a collection agency with the sole charged purpose of bringing in the bucks.

    In the past it has been made mention of several individuals offering to send in their computers for verification, which isn’t what they are there for. It’s also been noted in the past that indirect quotes state that the Settlement Center can’t make an exception as it might encourage others to fight this financial terrorism.

    So what you have is a racket going on. Once on the list, no one is going to pay any mind to any victim claiming innocence. There is no where to turn short of the courts for stopping the cost of court fees and all the associated headaches that go with it. In the meantime, the RIAA is working behind the scenes to communicate with the courts without the vicitms knowledge, trying to set up a guilty cloud to the court (influancing the outcome before it starts) and denying the victim any input from the start to the actual day of the court. No where in this does the cartels have to prove damages of actual costs, nor do they consider the victim in any manner than as the cash cow to be harvested. Matters not the victims financial health, possibility of being able to do what they claim, nor if they even did it.

    Less and less do I become inclined to ever be a customer of those that traffic in these sort of business dealings. They are ensuring that I won’t be the only one.

    Hopefully, as more cases like these crop up, the courts will begin to seriously question the validity of the RIAA’s evidence gathering methods and insist on full disclosure and verification.

    This could really go a long way to hurting future cases for them.

    I was reading that apparently there used to be a PC in the house that her adult children used. At the time of the “offense” she did not have a computer in the house but the wireless unsecured router was still plugged in.
