Kiddie porn HD searches

p2p news / p2pnet: American police can search hard drives for kiddie porn if owners subscribe to sites selling the images, says a US appeals court.

"There is a ‘fair probability’ customers of child pornography Web sites receive or download the illegal images, opening the door for police searches, according to the ruling by the U.S. 9th Circuit Court of Appeals," says Reuters, going on:

"The ruling affirmed a lower court’s decision supporting an affidavit by the Federal Bureau of Investigation for its probe of Lolitagurls.com Web site and subscriber Micah Gourde who’d, ’sought to suppress more than 100 images of child pornography seized from his home computer, arguing an FBI affidavit did not establish probable cause he had violated child pornography laws to justify a search of his computers’.”

But the majority opinion by Judge M. Margaret McKeown held there was a "reasonable inference" that supported a "fair probability" Gourde had downloaded banned images, says Reuters.

    My question is, who gets to decide who is a “perver”. What happens when “THEY” decide what YOU look at is illegal pr0n and get warrants to search your HD for “banned” stuff?

    I agree with both posts so far on this subject to some degree.

    There’s no place for perv’s in today’s society. That these sort of actions should not be placed upon any child’s life to feed those perv’s.

    I also agree that there is a point when the reaching to control these perv’s access becomes over-reaching and the results change from going after them to making each and every one of us subseptable to the same sort of laws. The first question comes to mind is who is going to watch the watchers? I sincerely hope no one believes that being one of these watchers would not be the ultimate goal of such a perv, to be able to legally access all the material his heart would desire.

    It is well known that when there is a bill, either sponsored by the media cartels, the various christian groups, or by the government itself (read as the likes of “The Patriot Act” that names are important to attach to the bill so that it sounds that it is presented as the greatest thought for protection since mom, apple pie, and children. In each case, when a proposed bill comes up with a name attached, indicating it seeks a favorable opinion through the name alone; one should look at it as a trojan horse to be inspected most throughly. Often hidden behind such a name is a bitter pill in one form or another.

    It’s not much of a stretch of imagination that looking for infringement could be attached to such a bill by the political shenagin’s of the copyright cartels.

    This article serves to highlight a point made a few weeks back on this site: whenever possible, use encryption. Since it looks like very soon, some law will come along authorizing the cartels to search through personal hard drives for downloaded media and sue the “offenders”, I would highly recommend everyone look into programs like truecrypt for protecting their private data. Note: I have nothing against going after the perverts, its the rest of us I’m woried about.

    Well “who” is going to be congress who writes the laws, “THEY” are going to search your computer and prosecute you if they find child porn… All of this with a judge signing off on the warrant of course…

    CBC Radio’s news and public affairs program “The Current” had a documentary last year on what happens when you’re falsely accused of child pornography offences.

    They followed up with another documentary this morning. This documentary dealt with “Operation Avalanche” which was a child pornography investigation into a company known as Landslide Productions. The Readys, who ran Landslide, originally started out selling legitimate adult pornography, then went on to sell memberships to pedophile-oriented sites featuring underage pornography.

    Not all of the customers who ended up in their credit card database purchased child pornography; the vast majority had purchased perfectly-legal adult pornography. Once the police got their hands on this database, however, they considered that ALL of the account holders were child pornographers and pedophiles.

    The mere presence of a credit card number in a database was enough for the UK and Irish police to go after people. It didn’t matter that no child pornography was found on the so-called suspect’s computer, or anywhere else in their house for that matter; it didn’t matter that credit card fraud was suspected and had been reported to the credit card company and the card had actually been cancelled. All of this didn’t matter a whit to the police–their attitude was “Well, you got away with it this time, but we’ll be keeping our eyes on you.”

    Another victim of credit card fraud was a physician, whose credit card number appeared in the database–he was dismissed from his position, just on the basis of an unsubstantiated allegation. (The physician had also reported that his credit card had been mis-used, and like the earlier case, there was absolutely no other evidence of criminal activity.)

    In the eyes of the public, there is no more heinous crime than child pornography–it is considered worse than rape, worse than murder. To be accused on the flimsiest of evidence — or NO evidence at all — is to be considered guilty. Peope have been falsely accused–reputations have been destroyed; marriages broken up, children taken away. Livelihoods have been lost. Even when there is NO evidence whatsoever, neither police nor prosecutors will EVER admit they were wrong, they will never apologize. All these measures are necessary we are told–these are all just casualties of war in the fight to protect the children. No one wants to see children exploited or abused, but in the war to save the village, one profits little by burning it to the ground.

    If the government doesn’t want you looking or reading some material, they’ll just pass laws forbidding you from doing that, and extend their searches to include the NEW forbidden material, thereby allowing even more searches based on the NEW forbidden stuff. I’m not defending child porn, but I do care about freedom from unreasonable searches.

    Gov of many countries bent plenty of laws under – “it’s for children…”. US is no exception. Believe me, it is not children they care about.
