Aussie law threatens Kazaa
p2pnet.net News:- A section of Australia’s Copyright Act that prohibits communicating copyright material, defined as to “make available online or electronically transmit,” could spell Kazaa’s undoing.
The major recording companies signalled their line of attack when arguing in the Federal Court last week that an Australian case would be different from ongoing action against Sharman in the US, says an Australian IT report here.
“Evidence was sought on how the system worked,” said Tony Bannon SC, representing music companies. “There is no suggestion of this material ever being made available before.”
There was “no counterpart in US law” for the action, with the US case focusing on “structural aspects” of the technology, the report quotes Bannon as saying, adding on that a decision is likely next week.
