Apple versus the Net
p2p news / p2pnet: The mainstream media are picking up the story that in the US, online journalists now have the same legal protection as their offline colleagues.
This follows a landmark decision overturning an earlier ruling which would have forced the publishers of Power Page and Apple Insider to reveal their sources to Apple boss Steve Jobs.
“Applying traditional First Amendment protections to the exploding universe of online journalism, a state appeals court on Friday rejected Apple Computer’s bid to unearth the identities of individuals who leaked inside information on a new company product to bloggers,” was the way the Mercury News summed it up.
Canada does not, however, have similar First Amendment rights and here, another multi-million-dollar company, this time Kazaa owner Sharman Networks, is also threatening an online reporter.
Sharman and Kazaa ceo Nikki Hemming are claiming they were defamed and as part of their suit, are demanding that p2pnet hand over the identities of comment posters.
In the US case, the EFF Electronic Frontier Foundation (EFF) acted for the online reporters.
In Canada, p2pnet publisher Jon Newton is at this point without legal representation. He has, however, declared that if necessary, in the interests of freedom of speech, he’ll defend the case by himself before a Canadian jury. He’s launched the Stop-the-Blogsuit Campaign to raise funds.

If the server is on US soil, hence US jurisdiction, and the Anon poster in non-canadian, hence foreign jurisdiction, and Jon apparantly not having IP records matching the anon poster, HOW the heck can this even be pursued!!!!! The way i see it the whole thing will revolved around Jon and only Jon. I do not see how the BC court can even claim any jurisdiction to the BS court filing by kaza et al.
I think Jurisdiction had to be fought before even going before a jury.
Hence, with all the above being out of jurisdiction and the anon-poster is well within his rights to say whatever the poster had to say on an US jurisdiction server, How can Jon even be held liable as a publisher? Or the Service Provider for that matter?
What is next???
Is the Govenment of China going to Sue Jon for promoting ways for Chinese citezens to circumvent their governments cencorship? This would equate to the same thing in the twisted logic of things.

Yup,
after reading all of the items, and looking over the complaint it appears that Kazaa wants the identity of one blogger in particular.
The other items are there to obscure the actual target. The suit should actually be titled ……
“Tell us what we want or we will ruin you”
In some places, that MIGHT be considered extortion.
Sadly, the legal system in the US doesn’t seem to mind, since they allow the RIAA to use the same tactics in their suits on individuals.

lets be honest… if Jon was in the states there wouldn’t probably be a libel suit or one worthy to stand on due to their 1st ammendment. However BC is a libel friendly provence in Canada with ancient laws and is not caught up with the rest of the world as far as Inet speech/bloggging is concerned. Also don’t get this mixed up with the whole of Canada either. Its a BC thing.

This is nonsense. In the states lawyers sue if they are paid to do so, regardless of the constitution or the merits of the lawsuit. George Wasington et all set the pattern. The constitution said “all men are created equal”, but Wasihngton had about 200 slaves when he died. So much for the crap called constitution.

The reason they think they can is because Oz law has already decided that if an Oz citizen can read it or hear it, Oz law can apply. Regardless of where it was actually done.
So yes if your country’s legal system had made the same decision relating to the reach of their laws, you could turn around and do that. I mean you could demand that Google provide search results in french regardless of their original language.
Technically every website that exists must now simultaneously obey the laws of ALL countries with net access. Even if some of those laws are mutually exclusive. That’s how dumb it all is.
Otherwise there’s going to need to be some kind of global decision made either way. I’d say it’ll continue with whereever it’s seen/heard, not whereever it’s done. It sounds dumb, but the bribers…sorry… “lobbyists” will insist that they be allowed to “fight crime even if the perps are outside our jurisdiction, so that the perps will have no safe havens to hide in” or some other equally ridiculous crap.
And of course the politicians will do exactly as the bri…sorry “lobbyists” tell them.

I don’t know but If I own a server here in the US and a Canadian court orders me to release IP information I’d laugh in their face. Unless I get it from a US court they have no teeth.

You are probably right rick.. Its out of jurisdiction. I would laugh at it too… But this is whats happening right now. against a US provider and a foriegn John Doe in Canadian court.
I get the feeling the only one gonna be screwed here is Jon for what someone else wrote.
The issue here is, Is Jon responsible for the writtings of a foriegn person commenting on Jons blog on a foriegn service that he pays for to relay his thoughts and make a living off of?
Is Jon responsible for what was on his moderateable (is that a word?) message board by another person?
Will this require Canadians who run message boards to delay user comments until reviewed for legalities before its allowed to be viewable?
If a message board on a foriegn server used as a canadian business to generate income has limitations imposed, How does that make Jon competitive with others doing the same in other provences and countries? Doesn’t make business scense to me and it puts canadian business at a disadvantage?
The only thing i can compare this to is porn servers, and even if canadian run, it falls under the jurisdiction of where the server is. Thats why most are in porn friendly states (as opposed to a bible belt state where u would be arrested and sued or similar cdn provence).
Aus as the world court thingy…:
I have read the aus law thingy about going after people in other countries.. its quite ridiculus. I do believe a judgement having been made in aus against lets say a US person will hold water in aus, however, how does one “collect a judgement” (assume its monetary)? I don’t think such a judgement made by a foriegn country against someone who has other rights can be enforced unless that person steps on Aus soil. I would think…. or Jon et al would have been sued there.

What happens if someone puts up nasty comments online about things that may not be true? Where do you draw the line? Does that amount to free speech? What if for example it was about your own young child?
Think about it for a moment. Imagine there were awful disgusting comments on the site about your own child – do you think that the poster should be allowed to be anonymous? That is the question here!
Lets have some real debate here on this subject instead of non-sensical back and forth slams.

This is a complete turn up for the books! John can monitor and delete things he doesn’t agree with? Apparently speech is only as free as John wants it to be.
