AllofMP3.com user threat
p2p news / p2pnet: MediaServices’ AllofMP3.com is a Russian site pointing out one of the ways a successful online music market could be developed.
It prices downloads by file size rather than a straight fee per item. But it’s an indie so naturally, the Big Four Organized Music members are trying to destroy it. And not content with that, they now seem ready to sic their IFPI on British AllofMP3.com punters, who can download an album for as little as £0.75 (about $1.40). Against that, a download from iTunes, supplied by EMI, Warner Music, Vivendi Universal and Sony BMG, can cost £9.79 (almost $18.20).
Hence, despite IFPI claims that the corporate online music industry is blossoming, because the Big Four wholesale their ‘product’ at anything between around 60 and 85 cents per, in real life, it’s practically non-existent. It’s also the reason why AllofMP3.com, not to mention indie musician sites and the p2p networks, are so popular.
The Big Music solution? Crush anything that looks even vaguely like competition and at the same time, try to sue your customers into buying grossly over-priced, formulaic music files from minimal lists.
As part of their latest marketing innovation, the Big Four’s IFPI (International Federation of Phonographic Industry) is now threatening UK AllofMP3.com users, claiming they’re infringing copyright.
“In theory, they could be sued by the music industry,” says ComputerActive. “The IFPI said that at the moment it was concentrating on stopping AllofMP3 from trading. But it wouldn’t rule out taking legal action against consumers.”
The IFPI, “is also hoping the credit card industry will help to clamp down and stop payments to this site,” it adds.

It could be interesting.
Especially if, like me, the sued individuals have a corresponding
purchased CD, Tape, Vinyl or 8-track of every song.
The trouble is actually being in a financial position to fight back.
In the Cecilia Gonzales Case, they DROPPED every count in which
she had a corresponding PURCHASED copy on her PC.
That was a can of worms they didn’t want to open.

Piracy is an amusing problem. Many moons ago a buddy and I bought and shared games for our Apple II’s. Possibly infringing on copyright, but in truth not only not damaging anyone, but actually benefitting the publishers. Neither of us would have purchased the games on our own, but the price was acceptable when halved.
Now, in Canada, where ALL purchasers of recording media have been found guilty of copyright infringement and are continually punished by means of a fine (the government and recording industry associations call it a ‘levy’) I would bet that if I were to download a movie, and put it on a DVD when I did my backup, that I could not be found guilty of infringement because I have paid my fine/levy/royalty in purchasing the blank DVD, CD, tape or whatever.

I hope the credit card industry will say no fucking way. The credit card industry mostly doesn’t care who they deal with as far as I can tell. It’s all money to them. 2% or so for every sale from the seller, and of course interest charges to the buyer.

According to AllofMP3.Com’s website they are licensed under the Russian Federation, and are legal by the laws of Russia.
Is it illegal to import music?
Will we have to pay customs fees?
At best it is a gray area of copyright law.
Tell me IFPI where in the US Copyright law does it say it is illegal to purchase music outside of the US? or the UK for that matter?
IMHO this is likely a ploy to cause AllofMP3 to spend all of their operational funds on lawyers, and distract from their business at hand.

Although I can’t be arsed to login as myself…..
I am so glad I encouraged my less than technology experts to cancel their subscription to Computer Active. Any stories published similar to that would have been submitted as anonymous to computer active in response….
