Kazaa office raid OK, says judge
p2pnet.net News:- Kazaa owner Sharman Networks’ bid to negate court orders which allowed the music industry to raid its homes and offices, last month, has failed.
The Australian Federal Court today upheld the validity of the orders issued to record companies to search and obtain evidence about the activities of Kazaa in Australia, says a story in The Age here, going on:
"The Anton Piller orders - by which a court empowers a party, that has alleged wrongdoing, the opportunity to enter premises and search for evidence - were issued by Justice Murray Wilcox on February 5.
"Justice Wilcox also dismissed an application by Sharman to delay proceedings against it until a similar case in the United States was finalised."
The raids were carried out by Big Music enforcer MIPI (Music Industry Privacy Investigations), owned by Universal, Festival Mushroom Records, EMI Music, Sony Music, Warner Music Australia and BMG Australia.
Lawyers representing Sharman Networks had alleged that all relevant matters were not disclosed to the judge when the application was made for the orders.
The case will return to court on March 23.
