Apple sues Creative. Again

p2p news / p2pnet: Last year Creative announced it planned to, "pursue aggressively" its US patent on a system used to navigate music on digital players.

Apple was in the direct line of fire, and Creative said it wanted iPod sales banned in America.

Last month, Apple countered with a lawsuit against Creative, and it’s now upped the ante even further with another patent infringement claim.

"The counter-suits come after Singapore-based Creative, the world’s number two MP3 player maker, filed patent complaints against Apple last month in a federal court and with a U.S. trade agency," says Reuters.

"Apple filed its latest suit in a district court in Texas last Thursday, claiming Creative has infringed at least three of its patents – one that involves displaying data on a computer, another for editing data using a portable media device, and the third for the creation of icons to organise files on a computer."

Looks like Apple is, "trying to assert their dominance on the whole user interface turf, as well as show Creative that the ‘litigate into profitability’ business model isn’t such a good one," says Ars Technica, adding:

"Creative’s stock price took another hit at the news and is now down to US$5.50 a share, an all-time low. Unless their new business plan is ‘pay off a whole bunch of lawyers’ student loans,’ things aren’t looking so good for Creative. One wonders how many more patents Apple can dredge up before the season premieres begin this fall."

NOTE: p2pnet is being sued by Sharman Networks and Nikki Hemming, ceo of p2p application Kazaa. “The suit is a little odd, since P2PNet.net is a champion of peer-to-peer file-sharing, which is the same business that Kazaa is in,” says The Globe & Mail. I just wonder if some lawyer out there somewhere has patented the concept of profit by litigation and is just waiting for the right moment to stick it to all the patent trolls out there. I kinda hope there is, it’d be really damned funny.
