RIAA vs Paul Wilke

p2pnet.net News:- The Big Four Organized Music cartel’s RIAA accused Paul Wilke of illegally distributing music online —— despite the fact none of the songs named were on his computer ‘illegally,’ or in any way ‘illegal’.

Actually, they were ripped from CDs he’d bought and paid for, he states.

Now the RIAA (Recording Industry Association of America), which wasn’t even able to get his name right, is demanding expedited discovery, claiming it doesn’t have enough evidence to go up against Wilke’s motion for summary judgment, says Recording Industry vs The People.

“I’m extremely disappointed the RIAA didn’t do its due diligence prior to bringing this suit,” Wilke’s lawyer, Daliah Saper told p2pnet.

“Everything in the motion for summary judgment was presented to them before we filed it, and I was very clear to the RIAA attorneys that this case was an exception. If they’d needed further information, Paul Wilke would have gladly cooperated. But they didn’t ask.”

This February Wilke was told he’d been sued for copyright infringement. So he hired a professional systems expert to check his computer.

“The professional confirmed that no such programs existed on his hard drive,” Saper told us.

“Paul contacted the Settlement Information Line to clear up any misunderstandings. He explained to the settlement hotline representative that he only used iTunes to download songs and that he’s never used any type of file sharing program. The remaining songs on his computer have all been transferred from purchased CD’s which are still in his possession.”

But instead of dropping the case, the ’settlement’ officer, who isn’t an attorney, told Wilke she had no authority to negotiate and could only offer to settle for $3,750.

“Paul’s subsequent attempts at contacting the actual attorneys for the RIAA were re-routed to the Settlement Hotline,” Saper declared. “Before he knew it, the RIAA named him in a suit filed in the Northern District of Illinois.”

    Jon, I like this site. I’ve been a member here for quite a while. I have no idea what would be the solution to this problem of spammers. I do know that the present one in the manner it is used, isn’t working. Instead the members are jumping through what appears to be non-working hoops where it is impossible to tell the difference between 0, O, and D. A, R, 1, I and L have simular problems. When you get those particular combos in multiples for the validation, it is impossible to make a post. I’m to the point that it is such a pain that I will no longer post until some other method is arrived at to solve this.

    I know you have your hands full at the present time. So I am sorry this comes at this moment with all your other troubles. But the hassles to post no longer make it worth the effort to write a response to post. Usually two or three attempts are necessary and only a rare few make it through on the first attempt. I feel I could have went easily a dozen attempts at the validation guess with no acceptable results at the end.

    Except for the O 0 problem, the other letters are relatively simple.

    Keep in mind that all Alpha are capitalized, and it’s a snap.

    With the O’s gone, I think problems would be gone

    As for me, I can never validate using Firefox. With Opera I can validate in one try about 1/2 the time only.

    I confirm, there is a problem with the validation system.

    Regardles, the place (p2pnet) is woth the effort, which I’m sure is temporary until Jon ha the time to work on the solution.

    May I recommend a reading again of my post.

    As I said, the validation does not work with Firefox in my computer. Thi is regardless of how clear the validation letters are or how many times I try to validate.
