p2pnet.net News:- Yesterday I wasn’t able to do any posts because I had to go to Vancouver on mainland BC in Canada (I live on Vancouver Island).
It would have been my first court appearance for the defamation case in which Kazaa boss Nikki Hemming is suing me for alleged defamation.
To be accurate, it wouldn’t have been my first appearance, exactly. That’ll come when the case is heard before a jury. This was more of voluntary attendance for a court hearing in which Hemming’s lawyer, Roger McConchie, assisted by his son, Al, would have attempted to disembowel my defence by pleading various motions, with my lawyer, Dan Burnett, on hand to present counter-arguments.
I say ‘would have’ because it turned out that there were many, many lawyers wanting to present many, many cases — so many, in fact,that they couldn’t all be heard. So I’ll be back in Vancouver on Monday.
Basically, Hemming claims I defamed her when I ran a post which featured quotes from an Associated Press story which says she was questioned about the sale of her “multimillion dollar Sydney mansion;” and, a Reader’s Write.
Canada’s libel laws desperately need bringing into the 21st digital century and the case is as much, if not more, about online freedom of expression as anything else. But even though it won’t go before a jury (something I’m very eager for) for at least another six to 12 months, I can’t go into detail because the pending law-suit effectively prevents me from speaking freely about the case, or components of it.
SLAPP is short for Strategic Lawsuit Against Public Participation.
Anyway, rather than not post anything, yesterday I ran a few headers with briefs, together with links to the sources I would probably have looked to. And that’s what I’m going to do from now on when I reach the end of my day and I have items I haven’t managed to reach.
I have another appointment I can’t avoid and so below are several items you may want to have a look at. Not only but also, from now on, I’m going to do this at the end of every day.

the Court’s workload will only delay you having to face the music John, Libel is libel despite your protestions which are ever changing smorgasbord of nonsense, non legal defences…the only third party you haven’t implicated is the darknet
