BREIN jumps p2p hobbyists
p2pnet.net News:- Dutch Anti-Piracy organization BREIN has successfully “taken down” 19 filesharing websites. They now reached a total of 103 this year. Among their new trophies are at least two BitTorrent sites; torrentsplanet.com and easytorrent.eu.
Although BREIN has no legal power, they can (just like every other person) threaten to sue the site admins.
Until now, no BitTorrent site admin has been taken to court in the Netherlands. However, BREIN sends letters to the owners of “infringing” sites, or their ISP’s, stating they could face up to four years in prison or a $54,000 fine.
These intimidating letters have proven to be an effective strategy to scare P2P hobbyists away. It’s an easy way out. Send a letter with a claim doesn’t involve having to actually prove someone is actually engaging in illegal behavior.
This is how it works: BREIN promises to drop the case if the site owners, take down their site, publicly admit that they infringed on copyright, promise to never do it again, and (if possible) hand over all available information on their members.
Another tactic BREIN uses is: identify the domain holder of a site, run a background check and visit the person at his/her home.
This is one of the most effective ways in which BREIN puts pressure on its “victims.”
We reported on this when it actually happened with the 20-year-old operator of TorrentIt (previously 123torrents).
After the Brein visit, TorrentIt completely stopped serving torrents.

I would *LOVE* for these types of folk to show up at my front door. If they think they can physically intimidate people without consequence, they’re bound to run into the wrong person eventually.
If these stuffed-shirts think they’ll come to my house and make threats, they’d be in for quite an ordeal. One wrong move (such as not leaving my property *immediately* when I tell them they are tresspassing) and they”d be lucky to leave walking upright and not in handcuffs. The law is very clear when it comes to trespassing, threats and intimidation, and use of lawful force to defend one’s property from people who do such things.
Also, it might be tons-o-fun to find out the identity of one of these thugs and perhaps pay them a little visit, at home too, maybe very very late at night when they and their families can appreciate the point that is being made.
I GUARANTEE that shit would stop in two seconds as soon as they had it handed back to them.
Perhaps someone should post some BREIN admin’s address and telephone numbers on USENET and see how they like those sorts of tactics used on them. There’s nothing illegal about paying someone a visit at 3AM to ‘discuss’ with them the errors of their ways.
